MAIN LADIES AUR GENT’S READY MADE GARMENTS KI KAI AIK DUKANON KA MALIK HUN JO MUKHTALIF MARKITON MAIN WAQ’E HAIN, MAIN NE HALAT KA MUTALI’A KIYA HAI JIN MEIN LADIES GARMENTS FAROKHT KARNA HALAL HAIN, AUR JAB TAAJIR KO YE ILM HO JAE KEH YE LIBAAS KHAREEDNE WALA UNHE ALLAH TALA KAY HARAM KARDAH KAAM MEIN ISTAMAL KAREGA TOU USSE YE LIBAAS FAROKHT KARNE JAIZ NAHI, LEKIN TAAJIR YA MULAZIM KO YE ILM KAISE HOGA KEH KHAREEDAR USSE ALLAH TALA KAY HARAM KARDAH KAAM MEIN ISTAMAL KAREGA, WO IS TARAH KEH FAROKHT KARNA HARAM KARDAH KAAM MEIN ISTAMAL KAREGA, WO IS TARAH KEH FAROKHT KARNE WALA AISI HALAT MEIN HO KEH AISE YE ILM NA HO KEH WO AISE KAAM MEIN ISTAMAL KAREGA?
JAWAB KA MATAN:
Alhamdulillah
Ladies libaas farokht karne wale taajir hazraat apni dukanon mein teen halat se khali nahi ho sakte:
Pehli halat:
Farokht karne wale kay ilm mein ho ya us ka ghalib guman ho keh ye is libaas ka istamal mabah aur jaiz hoga, aur usse kisi haram kaam mein istamal nahi kiya jaega, tou wo ye libaas farokht kar de tou us mein koi harj nahi.
Dosri halat:
Farokht karne wale ko ilm ho ya phir us ka ghalib guman ho keh ye libaas aur kapre haram kaam mein istamal honge, ya’ani ourat usse pehn kar gher mehram mardon kay samne izhaar zeenat karegi, tou us libaas aur kapre ka farokht karna haram hoga.
Kyun keh Allah Subhan wa Ta’la ka farman hai:
Aur tum gunah aur burai aur zulm o ziadati kay kamon mein aik dosre ka ta’awun mat karo. Al-maida (2)
Farokht karne wala taajir libaas aur kapre ki no’iyat aur us libaas ko khareedne wali ourat kay haal se ye ma’alom kar sakta hai keh is ka istamal kaisa hoga.
Tou ba’az libaas aur kapre aise hain jinhe dekh ki adata ye ma’alom ho jata hai keh ourat chahe jitni bhi be parda ho wo ye libaas apne khawand kay ilawa kisi aur kay samne nahi pehn sakti, aur usse pehn kar gher mehram aur ajnabi mardo kay samne ourat kay liye nikalna mumkin hi nahi.
Aur kuch aise kapre aur libaas hain jin kay mutaliq farokht karne wale ka ghalib guman aur ba’az oqaat yaqeen hota hai keh usse khareedne wali ourat usse haram kaam mein istamal karegi.
Tou farokht karne wale kay liye wajib aur zaroori hai keh khareedne wali ourat ki halat dekh kar jo usse ilm ho ya us kay ghalib guman mein aae us pe amal kare.
Aur ba’az oqaat libaas aur kapre ka istamal mabah aur jaiz ya phir haram istamal bhi ho sakta hai, lekin ourat kay liye parde ka iltzaam, ya phir hukomat ka unhe sakhti se parda karwana us libaas kay haram istamal se rook sakta hai, tou is halat mein ye libaas farokht karne mein koi harj nahi.
Kyun keh asal mein ba’i mabah hai aur haram nahi, is liye keh Allah Subhan wa Ta’la ka farman hai:
Aur Allah Tala ne khareed o farokht halal ki hai. Al-baqarah (275)
Is liye ye libaas aur kapra khareedne wale ko chahiye keh wahan istamal kare jahan Allah Tala ne halal kiya hai, aur usse haram tareeqe se istamal karna jaiz nahi.
Mundarj bala sotoor ki taeed mein zel mein chand aik ulma karam kay fatawi jaat pesh kiye jate hain:
Mustaqil fatwi committee kay ulma karam se darj zel sawal kiya gaya:
Ourat ki zebaish wali ashya ki tijarat karne ka hukum kiya hai, aur usse aisi ourat ko farokht karne ka hukum kiya hoga jis ki halat se farokht karne wale ko ye ma’alom hai keh ye usse istamal kar kay be pard ho kar gher mehram mardon kay samne sarkon par ghomegi, jaisa keh us ki halat samne nazar aa rahi ho, aur jis tarah keh ba’az ilaqon mein ye bemari aur musibat aam ho chuki hai ?
Committee kay ulma ka jawab tha:
“Agar taajir ko ilm hojae keh khareedne wali ourat us kay sath apne khawand kay liye banao senghar karegi, ya phir usse kuch ilm na ho sake tou phir us ki tijarat karna jaiz hai “

Fatwi committee kay ulma se ye sawal bhi daryaft kiya gaya:
Ourton kay makhsoos make-up ka saman aur zebaish ki ashya farokht karne ka hukum kiya hai?
Ye ilm mein rahe keh usse istamal karne wali aksar ourten be pard aur faajir aur Allah Tala aur us kay Rasool (ﷺ) ki nafarman qisam ki ourten hoti hain jo un ashya ko apne khawandon kay ilawa kisi aur kay samne zebaish ikhtyar karne kay liye istamal kari hain Allah Tala us se mehfooz rakhe ?
Committee kay ulma ka jawab tha:
” Agar ma’amla bilkul aise hi ho jaisa sawal mein bayan hua hai aur jab un ki halat se ye ma’alom ho tou phir un ko ye ashya farokht karna jaiz nahi; kyun keh ye gunah o burai aur zulm o ziadati mein mu’anat hogi aur Allah Subhan wa Tala ne is zulm se man’a karte hue farmaya hai;
Aur tum gunah o burai aur zulm o ziadati mein aik dosre ka ta’awun mat karo, ( Al-maidah) (2)

Aur committee se darj zel sawal bhi kiya gaya:
Mukhtalif qisam ki tangi aur chust ladies putlon jisse jeans, aur skirts wagera ka naam diya hai farokht karne ka hukum kia hai ?
Aur issi tarah pora set jo shirt aur putlon aur onchi airi wale jote farokht karne ka hukum kia hai ?
Aur issi tarah baalon ko rangne kay liye mukhtalif qisam kay rang aur cream khaas kar ourton kay liye makhsoos farokht ka hukum bhi bataen?
Shaffaf qisam ka ladies kapra ya jaise sheffon kay naam se mousom kiya jata hai, issi tarah adhe bazo wali frock aur us se bhi chote bazo ya bagher bazo aur chote ladies garare farokht karna ka hukum kiya hai?
Committee kay ulma ka jawab tha:
Har wo cheez jo haram tareeqe par istamal ki jati ho, ya ghalib guman mein keh ye haram mein istamal hoga ; tou usse taiyar karna aur bahir se mangwana aur usse farokht karna, aur musalmanon mein is ki tarweej karna haram hai,
Aj bohat si ourten us mein par chuki hain, Allah unhe sehat raah ki taraf hidayat de, wo shaffaf aur bareek aur tang aur chust aur chota libaas pehnti hain, aur is sab ki bina par pur fatan jaghen aur jisam kay a’za aur zebaish wali jagah aur ourat kay a’za banawat gher mehram mardon kay samne a’yan hoti hai,
Shaik ul Islam ban Taimiyah ka qoul hai:
“Har wo libaas jis kay mutaliq ghalib guman ho keh pehn kar musibat mein ta’awun liya jaega; tou jo shakhs us se m’asiyat wa nafarmani aur zulm mein madad aur mu’anat hasil kare us kay liye usse farokht karna aur silai kar kay dena jaiz nahi.
Issi liye jis kay mutaliq ye ma’alom ho keh wo is kay sath sharab noshi karega usse roti aur ghost farokht karna makroh samjha hai, aur jis kay mutaliq ye ilm ho keh wo ye khushbojat sharab noshi aur fahashi mein istamal karega tou usse ye farokht karni makroh hai, aur issi tarah har wo cheez jo asal mein mabah ho jis kay mutaliq ilm hojae keh is se musibat wa nafarmani mein mu’anat hasil ki jaegi “
You har Musliman taajir par Allah Tala ka taqwa ikhtyar karna wajib aur zaroori hai, aur wo apne Musliman bhaiyon ki khair khuwahi karte hue wo srif wohi cheez taiyar kare ya farokht ka nuqsan aur unhe zaroor puhnchta ho, aur haram se ijtinab kar kay halan par hi iktifa karne mein ghina aur Allah ki raza hai.
Aur jo koi bhi Allah Tala ka taqwa ikhtyar karega Allah Tala us kay liye chutkare ki raah nikal dega, aur usse rizq bhi wahan se dega jahan se usse wehm o guman bhi na ho. ( Al-Talaq) 2-3
Aur yahi khair khuwahi Emaan ka taqaza bhi hai, Allah Subhan wa Ta’la ka farman hai:
Aur momin mard aur ourat apas mein aik dosre kay dost hain wo naiki ka hukum dete aur burai se rokte hain.
( At-toubah) 71
Aur phir Rasool (ﷺ) ka bhi farman yahi hai:
” Deen khair khuwahi hai”
Sahabah ne arz kiya kis kay liye?
Tou Rasool (ﷺ) ne farmaya:
“Allah Tala kay liye, aur us kay Rasool kay liye, aur musalmanon imamon aur hukomranon kay liye, aur aam logon kay liye “
Issy Imam Muslim ne Sahih Bukhari mein riwayat kiya hai.
Aur jurur bin Abdullah رضى اللہ تعالى عنہما bayan karte hain keh:
Main ne Rasool (ﷺ) se is bat par bait ki keh main namaz ki pabandi karonga, aur zakat ada karonga, aur har Musalman kay liye khair khuwahi karonga”
Muntafiq عليه
Shaikh al Islam رحمه الله ki sabqa Kalam:
” Aur is liye unhe ne aise shakhs kay liye roti aur ghost farokht karna haram makroh samjha hai jis kay mutaliq ilm hojae keh wo is par sharab noshi karega…..
Kirahat tereemi murad hai, jaisa keh dosre maqam par shaikh رحمه الله kay fatwe jaat se ma’alom hota hai.
