Iddat Me Nikaah Ka Hukm

Aurton Me Ek Buraai Phailti Nazar Aa Rahi Hai Woh Yeh Ke Iddat Me Hi Dusre Mard Se SHADI Kar Leti Hain Jab Ke Allaah Ne Iddat Guzaarne Waliyon Ko Apni Iddat Mukammal Karne Aur Mardon Ko Unki Iddat Guzar Jane Ke Baad Un Se Nikaah Karne Ka Hukm Diya Hai, Farman e Ilaahi Hai:

 

وَلَا جُنَاحَ عَلَيْكُمْ فِيمَا عَرَّضْتُمْ بِهِ مِنْ خِطْبَةِ النِّسَاءِ أَوْ أَكْنَنْتُمْ فِي أَنْفُسِكُمْ عَلِمَ اللهُ أَنَّكُمْ سَتَذْكُرُونَهُنَّ وَلَكِنْ لَا تُوَاعِدُوهُنَّ سِرًّا إِلَّا أَنْ تَقُولُوا قَوْلًا مَعْرُوفًا وَلَا تَعْزِمُوا عُقْدَةَ النِّكَاحِ حَتَّى يَبْلُغَ الْكِتَابُ أَجَلَهُ وَاعْلَمُوا أَنَّ اللَّهَ يَعْلَمُ مَا فِي أَنْفُسِكُمْ فَاحْذَرُوهُ وَاعْلَمُوا أَنَّ اللَّهَ غَفُورٌ حَلِيمٌ

 

“Tum par is mein koi gunaah nahi ke tum isharatan kinayatan un aurton se nikah ke mutalliq kaho, ya apne dil mein posheedah iradah karo, Allah Ta’ala ko ilm hai ke tum zaroor un ko yaad karoge, lekin tum un se posheedah wa’de na kar lo haan yeh aur baat hai ke tum bhali baat bola karo aur aqd-e-nikah jab tak ke iddat khatm na ho jaaye pakka na karo, jaan rakho ke Allah Ta’ala ko tumhaare dilon ki baaton ka bhi ilm hai, tum us se khauf khaate raha karo aur yeh bhi jaan rakho ke Allah Ta’ala bakhshish aur ilm waala hai.”

(Surah Al Baqarah: 235)

 

Yah Aayat Us Aurat Ke Baare Me Hai Jis Ke Shauhar Ka Inteqaal Ho Jaaye, Ke Woh Aurat Jis Ka Shohar Wafaat Paa Jaaye Us Se Koi Mard Us Waqt Tak Nikaah Na Kare Jab Tak Ke Woh Wafaat Ki Iddat Puri Na Kar Le, Yahan Tak Ke Iddat Me Nikaah Ka Paigaam Dena Bhi Jaiz Nahi Hai Albatta Isharah Kinayah Me Nikaah Ka Izhaar Kiya Ja Sakta Hai. Misaal Ke Taur Par Yeh Kahe Ke Me Kisi Aurat Se Shadi Karna Chahta Hun. Yahi Hukm Mutallaqa Salasah (Jise 3 Talaq Yani Talaqe Ba’in Di Gai Ho) Aur Khula Wali Ka Hai. Pehli Aur Dusri Talaaq Ki Iddat Raj’ee Hoti Hai Is Wajah Se Is Iddat Me Na Sarahatan Nikaah Ka Paigaam Dena Jaiz Hai Aur Na Hi Kinayah Me KuyKe Mumkin Hai Ki Shauhar Rujoo’ Kar Le.

Is Aayat Se Hame Malum Ho Gaya Ke Halat E Iddat Me Chahe Talaaq Ho Ya Wafaat Ya Khula Ho Nikaah Ka Paigaam Dena Jaiz Nahi Hai Aur Shadi Karna Bhi Jaiz Nahi Hai Balke Iddat Me Nikaah Ki Hurmat Par Ahl e Ilm Ka Ittifaq Hai, Magar Apni Society Me Aaj Kal Aurton Me Iddat Ke Talluq Se La Parwaahi Dekhi Ja Rahi Hai. Kuch Aurtein Aisi Dekhne Ko Mil Rahi Hain Jo Iddat Ko Koi Matlab Nahi Deti Yani Iddat Me Jin Baton Ka Khayal Kiya Jana Chahiye Woh Nahi Karti Aur Kuch Aurtein Is Qadar Deen Se Door Nazar Aati Hain Ke Iddat Me Bhi Dusre Mard Se SHADI Kar Leti Hain.

Yaha Isi SAWAL Ka Jawab Dena Maqsood Hai Ke Agar Koi Aurat Dauran E Iddat Nikaah Kar Leti Hai To Uska Shari’at Me Kya Hukm Hai?

Ek Taraf Nikaah Ke Sahih Ke Liye Nikaah Ke Mawane’ (Nikaah Se Rokne Waali Cheezon) Ka Na Paya Jana Zaroori Hai Aur Iddat Nikaah Ke Mawane’ (Rukawat) Me Se Hai Aur Dusri Taraf Ham Ne Upar Quran Ki Roshni Me Yeh Jaana Ke Iddat Me Nikaah Ka Paigaam Dena Ya Nikaah Karna Jaiz Nahi Hai. Ahl e Ilm Ne Dauran E Iddat Nikaah Karne Ko Haraam Qaraar Diya Hai. Is Wajah Se Iddat Me Jo Nikaah Kiya Gaya Woh Nikaah Baatil Hai.

Dauraan E Iddat Nikaah Huwa Hi Nahi To Fir Mard Aur Aurat Ek Sath Nahi Reh Sakte Un Dono Ko Ek Dusre Se Alag Kar Diya Jaayega. Alag Karne Ke Liye Talaaq Ki Zaroorat Nahi Hai KuyKe Talaaq To Miya Biwi Ke Darmiyan Hoti Hai Jab Ke Yah Dono Miya Biwi Ke Hukm Me Nahi Hain.

Dono Ko Alag Karne Ke Baad Aurat Pehle Shauhar Ki Baqi Ki Iddat Mukammal Kare Fir Chahe To Wali Ki Razamandi Ke Sath Maujudah Mard Ke Sath Nikaah Kar Sakti Hai Aur Iddat Me Nikaah Karna Gunaah Hone Ke Sabab Allaah Se Sachchi Taubah Bhi Kare, Dauraan E Iddat Nikaah Karne Wali Aurat Se Mutalliq Umar Radhiallahu Anhu Ka Fatwah Yah Hai:

 

قال عمر: ايما امرأة في نكحت في عدتها ولم يدخل بها الذي تزوجها فرق بينهما ثم اعتدت بقية عدتها من زوجها الأول وكان خاطبا من الخطاب وان دخل بها فرق بينهما ثم اعتدت بقية عدتها من زوجها الأول ثم اعتدت من الاخر ولم ينكحها ابدا

“Umar Radhiallahu Anhu Ne Kaha Ke Jo Aurat Apni Iddat Me Nikaah Kar Le Aur Us Se Mard Ne Abhi Hambistri Nahi Kiya Hai To Dono Ko Alag Kara Diya Jaayega Fir Aurat Pehle Shauhar Ki Baqi Ki Iddat Mukammal Karegi Aur Chahe To Dusra Shauhar Paigaam Dene Walon Ki Tarah Paigaam De Sakta Hai Aur Agar Dusre Mard Ne Dukhul Kar Liya To Dono Ko Alag Kar Diya Jaayega, Fir Aurat Pehle Shauhar Ki Iddat Guzaaregi Aur Yeh Dusra Mard Us Aurat Se Zindagi Me Kabhi Nikaah Nahi Kar Sakta Hai.

Umar Radhiallahu Anhu Ke Fatwah Me Do Halaton Ka Zikar Hai, Ek Yeh Hai Ke Iddat Me Nikaah Karne Wali Aurat Ke Sath Dusre Mard Ne Jima’ Nahi Kiya Ho To Alag Ke Baad Pehle Shauhar Ki Baqi Ki Iddat Guzaar Kar Dusre Mard Se Nikaah Kar Sakti Hai. Dusri Halat Yah Hai Ke Agar Dusre Mard Ne Jima’ Kar Liya To Fir Pehle Shauhar Ki Iddat Guzaaregi Uske Baad Dusre Mard Ki Bhi Iddat Guzaaregi Aur Dusre Mard Se Fir Kabhi Nikaah Nahi Kar Sakegi.

Khulasa Yah Hai Ke Dauraan E Iddat Nikaah Karne Wali Aurat Ko Mard Se Alag Kar Diya Jaaega Aur Pehle Shauhar Ki Baqi Ki Iddat Guzaar Kar Dusre Mard Se Nikaah Karna Jaiz Hoga, Dusre Shauhar Ki Iddat Guzarna Zaroori Nahi Hai Albatta Umar Radhiallahu Anhu Ke Fatwe Ki Roshni Me Ihtiyaat Yeh Hai Ke Dusri Iddat Bhi Guzaari Jaaye Agar Jima’ Huwa Hai To. Aur Jahan Tak Umar Radhiallahu Anhu Ki Yeh Baat Hai Ke Dusre Mard Se Jima’ Huwa Ho To Aapas Me Fir Nikaah Nahi Hoga Us Se Unhone Rujoo’ Kar Liya Tha Is Wajah Se Sahih Yah Hai Ke Iddat Ke Baad Dusre Mard Se Nikaah Karna Jaiz Hai YAHI Jumhoor Ulama Ka Mauqif Hai.
