22. MAAL-E-GHANIMAT MEIN KHAYANAT KARNA [Stealing from booty]

 Maal-e-Yateem mein khayanat karna

Bait-ul-maal aur Zakaat se khayanat karna kabeera gunah hai Allah Tala ne farmaya:
اِنَّ اللّٰهَ لَا يُحِبُّ الۡخَآئِنِيۡنَ ۞

 

“Be shak Allah khayanat kare walon ko passand nahi karta”.

( Al-Anfal 8/58 )

 

Aur Allah Tala ne farmaya:

 

وَمَا كَانَ لِنَبِىٍّ اَنۡ يَّغُلَّ‌ؕ وَمَنۡ يَّغۡلُلۡ يَاۡتِ بِمَا غَلَّ يَوۡمَ الۡقِيٰمَةِ‌ ۚ

 

 

“Aur kisi Nabi kay Shayan e Shan nahi keh wo ( kisi tarah ki ) khayanat kare aur jo khayanat karega, Qayamat kay din apni khayanat laa hasil karega “.

( Al-Imran 3/161 )

Abu Huraira رضي الله عنه bayan karte hain, Rasool Allah ﷺ aik Roz hamen Khutba irshad farmane kay liye khare hue tou khayanat ka zikar farmaya: tou Ap ne us kay maamle ko bara sangeen qarar dete hue farmaya: main tum mein se kisi ko is haal mein na paon keh wo Roz e qayamat aae tou us ki gardan par oont sawar hua aur wo awaz nikal raha ho, phir ye shakhs kahe: Allah kay Rasool! Meri madad farmaen, tou main kahonga: main tumhare mutaliq Allah se kisi cheez ka ikhtyar nahi rakhta, main ne tumhen ( mukammal Deen) puhncha diya tha, main tum mein se kisi ko is haal mein na paon keh wo Qayamat kay Roz aae tou us ki gardan par ghoora sawar ho aur wo hinhina raha ho, tou wo mehz kahe: Allah kay Rasool! Meri madad farmaen, tou main kahonga: main tumhare liye Allah kay han kisi cheez ka bhi ikhtyar nahi rakhta, main ne tou puhncha diya tha, main tum se kisi ko is haal mein na paon keh wo Qayamat kay din is haal mein aae keh us ki gardan par bakri ho aur wo mamya rahi ho aur wo shakhs kahe: Allah kay Rasool! Meri madad farmaen, tou main kahon: main tumhare mutaliq Allah kay han kisi cheez ka bhi ikhtyar nahi rakhta, main ne tou ( Deen) puhncha diya tha. Main tum mein se kisi ko is haal mein na paon keh wo Roz e qayamat aae tou us ki gardan par koi jaan ho aur wo awaz nikal raha ho, tou wo shakhs kahega: Allah kay Rasool! Meri madad farmaen, tou main kahonga Main tumhare liye Allah kay han kisi cheez ka bhi ikhtiyar nahi rakhta, main ne tou tumhen puhncha diya tha, main tum mein se kisi ko is haal mein na paon keh wo Qayamat kay din aae tou us ki gardan par kapra hil raha ho, tou wo shakhs kahe, Allah kay Rasool! Meri madad farmaen, tou main kahon: main tumhare mutaliq Allah kay han kuch bhi ikhtyar nahi rakhta, main ne tou puhncha diya tha. Main tum mein se kisi ko is haal mein na paon keh wo Roz e qayamat aae tou us ki gardan par Sona ya chandi aur wo shakhs kahe: Allah kay Rasool! Meri madad farmaen, tou main kahon: main tumhare liye Allah kay han kisi cheez ka ikhtyar nahi rakhta, main ne tou ( Deen ) puhncha diya tha “.

Pass jo shakhs Maal-e-Yateem ki in mazkora ashiya mein se, Mujahideen mein taqseem hone se pehle, ya Ameer ki bait-ul-maal se ijazat kay bagher ya fuqara kay liye jama ki gai Zakaat se koi cheez bhi hasil kar le, tou wo Roz e qayamat is haal mein aega keh wo us ki gardan par sawar hogi’ jaisa keh Allah Tala ne Quran Majeed mein farmaya hai:

وَمَنۡ يَّغۡلُلۡ يَاۡتِ بِمَا غَلَّ يَوۡمَ الۡقِيٰمَةِ‌ ۚ

 

 

“Aur jo khayanat karega, Qayamat kay din apni khayanat laa hasil karega”.

( Al-Imran 3/161 )

 

Aur Nabi ﷺ ka farman hai keh:


“Soi dhage tak ada kar do aur khayanat se bacho kyun keh Roz e qayamat wo apne khaain kay liye baais Aar hogi”.

Aur Nabi ﷺ kay farman kay mutabiq, jab Ap ne Ibne Tabbiya ko sadqa wusool karne par amil muq’qarar farmaya, aur wo aae tou unho ne kaha: ye ap kay liye hai aur ye mujhe hadiya ( tuhfa) diya gaya hai, ye sun kar Nabi ﷺ minbar par charhe aur Allah Tala ki Hamd o Sana bayan ki aur farmaya: Allah ki qasam! Tum mein se jo shakhs koi cheez na haq qubool karta hai, tou wo Roz e qayamat usse uthae hue aega. Pass main tum mein kisi admi se is haal mein mulaqat na karon keh wo Allah se mulaqat kare tou us ne oont uthaya hua ho aur wo awaz nikal raha ho, ya gaaye uthai hoi aur wo awaz nikal rahi ho ya bakri ho jo mamya rahi ho, phir Ap ﷺ ne apna hath buland kiya tou farmaya “Ae Allah! Kia main ne puhncha dia?” Abu Hurairah رضي الله عنه bayan karte hain, ham RasullAllah ﷺ kay Sath khaibar ki taraf rawana hue, wahan hamen Fatah naseeb hui tou hamen wahan maale ghaneemat mein Sona mila na chandi, hamen anaj , ghalla aur kapre ghaneemat mein mile, phir waadi ya’ani Qura ki taraf rawana hue, aur RasullAllah ﷺ kay Sath ek ghulam tha Jo Banu Juzam qabeela kay rafaa’ah bin yazeed Banu zabeeb naami shakhs ne apko hiba kia tha, jab ham ne wadi mein parao dala tou RasullAllah ﷺ ka ghulam apki sawari ka palaan kholne laga tou use aik teer laga jis se uski maut waqe’ hogai, tou ham ne kaha: Allah kay Rasul! Use shahadat Mubarak ho, tou RasullAllah ﷺ ne farmaya:

“Hargiz nahin, Allah ki Qasam! Shawl Jo us ne maale ghaneemat se , uski taqseem se pehle hi chura li thi, woh us par aag ban kar bharak rahi hai”

Rawi bayan karte hain, log tou ghabra gae, aik aadmi joote ka aik ya do tasme laya (us ne kaha, khaibar kay din mujhe mile the) tou RasullAllah ﷺ ne farmaya:

“Aik tasma ya do tasme aag kay hain” [ Bukhari: 4234; Muslim: 115]

Abdullah bin Amr رضي الله عنهما bayan karte hain, karkarah naami shakhs RasullAllah ﷺ kay saman par mamoor tha, jab woh faut ho gaya tou Nabi ﷺ ne farmaya:

“Woh Jahannumi hai “

Tou Sahabah uska haal janne kay lie uski taraf chal die, unhon ne aik Chadar Dekhi Jo us ne khayanat ki thi [Bukhari: 3074]

Zaid bin Khalid Juhni رضي الله عنه se riwayat hai keh aik aadmi ne ghazwahe Khaibar mein khayanat ki tou Nabi ﷺ ne uski namaze janazah parhne se mana’ farma dia aur farmaya:

“Tumhare is Sathi ne Allah ki raah mein khayanat ki hai”

Rawi bayan karte hain jab ham ne us kay saman ki talashi li tou ham ne us mein yahood kay nageenon mein se aik nageena paya Jo sirf do dirham kay masawi tha , imam Ahmed رضي الله عنه ne farmaya: hamen ma’lum Nahin keh Nabi ﷺ ne khaain aur khud kushi karne wale kay Siwa kisi aur kisi aur ki namaze janazah parhne se mana’ farmaya ho

Aur Nabi ﷺ ne farmaya:

“Sadqaat wusool karne wale zimmedaran ko Milne wale tahaif khiyanat hain”

Is bat kay muta’alliq bohot si ahadith hain, in mein se ba’az ka baab zulm mein bayan hoga, zulm ki 3 aqsaam hain:

1- Baatil tareeqe se maal khana

2- Qatlo maar kutai, a’aza torne aur zakham laga kar bandon par zulm karna

3- Gaali galoch, la’an ta’an, bura bhala keh kar aur tohmat laga kar bandon par zulm karna

Nabi ﷺ ne Mina mein khitab kia tou farmaya:

“Sun lo! Tumhari jaanen, tumhare amwal aur tumhari izzaten tumhare is din, tumhare is mahine aur tumhare is sheher ko hurmat ki tarah tum par Haram hain” [Bukhari: 4406; Muslim: 1679]

Aur Aap ﷺ ne farmaya:

“Allah taharat kay bagher maal qubool karta hai na maale khiyanat se sadqah qubool karta hai “ [Muslim: 224]

Ham Allah se us kay mehboob aur pasandeedah aa’mal ki darkhwast karte hain, kyun keh woh sakhi daata hai.

Misappropriating Spoils of War, Muslim Funds or Zakat

Allah Most High says,

{ If thou fearest treachery from any group, throw back (their covenant) to them, (so as to be) on equal terms: for Allah loveth not the treacherous.}

(08:58)

He says too,

{No Prophet could ever act dishonestly. If any person acts dishonestly he shall, on the Day of Judgement, restore what he misappropriated, then shall every soul receive its due whatever it earned.}

(02:161)

Abu Hurairah heard the Prophet (pbuh) mentioning Ghulul, emphasizing its magnitude, and declaring that it was a grave sin, saying,”Do not commit Ghalul, for I would not like to see anyone amongst you on the day of Judgement, carrying over his neck a camel that will be grunting. Such a man will say,”O Allah’s Apostle! Intercede with Allah for me!” and I will say,” I cannot help you for I conveyed Allahs’ message to you. Nor would I like to see a man carrying over his neck a horse that will be neighing. Such a man will be saying,” O Allahs’ Apostle! Intercede with Allah for me!” and I will reply,” I cannot help you, for I conveyed Allahs’ message to you”.Nor should I like to see a man carrying over his neck a sheep that will be bleating, or one carrying over his neck a crying soul, or one carrying over his neck clothes which will be fluttering, or one carrying over his neck gold and silver. Such men will be saying,’ 0 Allah’s Apostle! Intercede with Allah for us, and I will say,” I cannot help you for I conveyed Allah’s message to you.”¹

Whosoever takes from these kinds of the spoils before they are distributed among the fighters or something from the Muslim’s common treasury without the Imam’s permission, or something from the Zakat fund which is assigned to the poor, will come on the Day of Judgement carrying it on his neck.

The Prophet (pbuh) said, “Render back (even) the thread and the needle, and shun Ghalul, for it puts man (who commits it) to shame on the Day of Judgement.”²

The Prophet appointed a man named “Ibn Al-Lutaibah for collecting the Zakah. When he returned he said, “This (i.e. the Zakah) is for you and this has been given to me as a present: whereupon, the Prophet ascended the pulpit and gave a sermon, saying, “By Allah, whoever takes something from the resources of the Zakat (unlawfully) will meet Allah carrying it on his neck on the Day of Resurrection.

Verily, I may know one of you who will meet Allah carrying on his neck a camel what will be grunting, or a cow that will be mooing, or a sheep that will be bleating. Then the Prophet raised his hands till we saw the whiteness of his armpits, and he said thrice “0 Allah! Have I not conveyed your message (to them)?”³

Abu Hurairah narrated, “When we conquered Khaibar, we gained neither gold nor silver as booty, but we gained goods, food and clothes. Then we departed with Allah’s apostle to the valley of ” Al-Qira”, and at that time Allah’s apostle had a slave of his called “Rifa’ah lbn Yazid who had been presented to him by a man who had leprosy.

While the slave was dismounting the saddle of Allah’s apostle, an arrow (its thrower was unknown) came and hit him. The people said, ” Congratulations to him on his martyrdom”. Allah’s apostle said,” No, by him in whose hand is my soul, he had a sheet (of cloth) which he had taken (illegally) on the day of Khaibar from the booty before its distribution and has become a flame of fire burning him.” On hearing that, a man brought one or two leather straps of shoes to the Prophet and said, “These are the things I took (illegally)”

“This is a strap, or these are two straps, of fire”, the Prophet said.”¹

`Abdullah Ibn ‘ Amr related,

“There was a man who looked after the family and the belongings of the Prophet was called “Karkarah.”

The man died and Allah’s apostle said,” He is in the Hell fire. The people then went to look at him and found in his place a cloak he has stolen from the war booty.”²

Zaid Ibn Khalid AI-Juhani narrated,

 “A man has stolen something from the booty of Khaibar. As a result, the Prophet refused to observe the funeral prayer for him and said to his companions ” Observe prayer for your fellowman, (and I would never observe it for him because he has stolen (from the booty obtained from war) in the way of Allah”

Zaid added, “We, then, searched that man, luggage and found therein some of the Jews pear’s which were worth two drachmas.”³

Imam Ahmad related, “Allah’s apostle avoided prayer for none but the one who had stolen from the war booty and the one who had committed suicide. The Prophet said, “The gifts presented to official employees are a sort of Ghulul.” And there are numerous Prophetic traditions related to this point, and some of them are mentioned in the chapter of “Injustice”⁴

Injustice, generally speaking, may be classified into three categories:

  1. a) To violently spoil one’s property.
  2. b) To act tyrannically by unjustly killing, beating or wounding people.
  3. c) To aggressively insult, curse, slander and ill-treat people. The Prophet, while being at “Mina” gave a sermon that ended:

“0 People! Your belongings, and your honor are sacred to each other as sacred as this day, this month, and this city.” and: prayer is invalid without ablution, and charity is unlawful from Ghalul.”⁵
