31. BURA QAAZI [Being corrupt in rendering judgement]

BURA QAZI:

 

Allah ta’ala ne farmaya:

 

إِنَّآ أَنزَلْنَا ٱلتَّوْرَىٰةَ فِيهَا هُدًى وَنُورٌ ۚ يَحْكُمُ بِهَا ٱلنَّبِيُّونَ ٱلَّذِينَ أَسْلَمُوا۟ لِلَّذِينَ هَادُوا۟ وَٱلرَّبَّٰنِيُّونَ وَٱلْأَحْبَارُ بِمَا ٱسْتُحْفِظُوا۟ مِن كِتَٰبِ ٱللَّهِ وَكَانُوا۟ عَلَيْهِ شُهَدَآءَ ۚ فَلَا تَخْشَوُا۟ ٱلنَّاسَ وَٱخْشَوْنِ وَلَا تَشْتَرُوا۟ بِـَٔايَٰتِى ثَمَنًا قَلِيلًا ۚ وَمَن لَّمْ يَحْكُم بِمَآ أَنزَلَ ٱللَّهُ فَأُو۟لَٰٓئِكَ هُمُ ٱلْكَٰفِرُونَ۞

 

“Aur jo koi Allah ki nazil kardah sharee’at kay mutabiq faisla na kare tou yahi log kafir hain”

Al-Ma’idah 5 : 44

 

Allah ta’ala ne farmaya:

 

وَكَتَبْنَا عَلَيْهِمْ فِيهَآ أَنَّ ٱلنَّفْسَ بِٱلنَّفْسِ وَٱلْعَيْنَ بِٱلْعَيْنِ وَٱلْأَنفَ بِٱلْأَنفِ وَٱلْأُذُنَ بِٱلْأُذُنِ وَٱلسِّنَّ بِٱلسِّنِّ وَٱلْجُرُوحَ قِصَاصٌ ۚ فَمَن تَصَدَّقَ بِهِۦ فَهُوَ كَفَّارَةٌ لَّهُۥ ۚ وَمَن لَّمْ يَحْكُم بِمَآ أَنزَلَ ٱللَّهُ فَأُو۟لَٰٓئِكَ هُمُ ٱلظَّٰلِمُونَ۞

 

“Aur jo koi Allah ki nazil kardah sharee’at kay mutabiq faisla na kare tou yahi log zalim hain”

Al-Ma’idah 5 : 45

 

Allah ta’ala ne farmaya:

 

وَلْيَحْكُمْ أَهْلُ ٱلْإِنجِيلِ بِمَآ أَنزَلَ ٱللَّهُ فِيهِ ۚ وَمَن لَّمْ يَحْكُم بِمَآ أَنزَلَ ٱللَّهُ فَأُو۟لَٰٓئِكَ هُمُ ٱلْفَٰسِقُونَ۞

 

“Aur jo koi Allah ki nazil kardah sharee’at kay mutabiq faisla na kare tou yahi log fasiq hain”

Al-Ma’idah 5 : 47

 

Talha bin ubaidullah رضي الله عنه Nabi ﷺ se riwayat karte hain keh aap ne farmaya:

“Allah us hukumran ki namaz qubool nahin karta jo Allah ki nazil kardah sharee’at kay elawa kisi aur Cheez kay sath faisle karta hai” [1]

Buraidah رضي الله عنه bayan karte hain RasullAllah ﷺ ne farmaya:

“Qazi 3 qisam kay hain, aik qazi jannati aur 2 Jahannumi hain, woh qazi jis ne haq pehchan kar us kay mutabiq faisla kia tou woh jannati hai, woh qazi jis ne haq pehchan kar phir jaan bujh kar zulm kia tou woh Jahannumi hai aur woh qazi jis ne ilm kay bagher faisla kia tou woh bhi jahannumi hai” [Abu Dawood: 3573; Ibne Majah: 23152]

Sahaba ne arz kia jo shakhs la-ilmi main faisla karta hai uska kia gunah hai? Farmaya: “uska gunah yeh hai keh woh jab tak ilm hasil na kar leta tou woh qazi na banta”

Abu Hurairah رضي الله عنه bayan karte hain RasullAllah ﷺ ne farmaya:

“Jise qazi bana dia gaya woh tou churi kay bagher zibah kar dia gaya” [Abu Dawood: 3571]

Fuzail bin Ayaz رحمه الله ne farmaya:

“Qazi ko chahie keh woh aik din faisla kare aur aik din apne nafs par roe”

Muhammad bin wase’ رحمه الله ne farmaya:

Roz-e-Qayamat hisab kay lie sab se pehle qazion ko bulaya jaega

Ayesha رضي الله عنها bayan karti hain main ne RasullAllah ﷺ ko farmate hue suna:

“Munsif qazi ko Roz-e-Qayamat laya jaega woh hisab ki jis shiddat se do chaar hoga tou woh pasand karega us ne kisi do aadmion kay darmian ek khajoor kay baare mein bhi faisla na kia hota” [Ahmed; Ibne Hibban]

Maaz bin jabal رضي الله عنه se riwayat hai keh RasullAllah ﷺ ne farmaya:

Qazi Jahannum mein Adan (yaman kay sheher) se bhi ziada door musafat jitna phisalta chala Jaega”

[1] iski sanad mein Abdullah bin Muhammad adwi rawi kamzor aur muttahim hai aur yeh un riwayaton mein se hai jinka imam Hakim ne inkar kia hai (munzari) is kay alfaz hain: “Allah zalim badshah ki namaz qubool nahin karta”
Imam zahabi ne apne risale as sughra mein farmaya: yeh aisi sanad se marwi hai jis se main mutmain nahin hun

Ali bin Abi talib bayan karte hain main ne RasullAllah ﷺ ko farmate hue suna:

“Har hukumran aur qazi ko Roz-e-Qayamat Allah عزوجل kay huzoor pule siraat par la khara kia jaega phir us kay raazon ko nashar kia jaega aur tamam makhlooq kay samne unhen parha jaega, agar woh munsif hua tou Allah us kay adal ki wajah se use nijat dega aur agar woh us kay elawa (zalim) hua tou phir uski wajah se pul shiddat se kanpega aur us kay tamam a’aza kay darmian itna itna faasla hojaega phir pul use sath lie Jahannum ki taraf phat jaega,”

Makhool bayan karte hain: “agar mujhe mansabe qaza aur apni gardan maare jane kay darmian kisi aik ko muntakhib karne ka ikhtiyar dia jae tou main qazi banne ki nisbat apni gardan mari Jane ko muntakhib karun”

Ayyub Sukhtiani ne farmaya:

“Main ne logon mein sab se ziada aalim ko is (qaza) se un mein sab se ziada door rehne (bhagne) wala paya”

Imam Sauri se kaha gaya keh Shuraih ko qazi bana dia gaya hai, unhon ne kaha: unhon ne is aadmi ko kharab kardia

Malik bin munzar ne Muhammad bin wase’ ko Basra ka qazi banane kay lie bulaya tou unhon ne inkar kar dia, woh bar bar use kehta raha aur phir kaha: tum is mansab par zarur bethoge warna main tumhen kaure marunga tou unhon ne kaha: agar tum aisa karoge tou tum badshah ho (kar sakte ho) kyun keh dunia ki zillat akhirat ki zillat se behtar hai

Wahab bin munabbah ne farmaya: jab Hakim zulm ka iradah karta hai us kay mutabiq amal karta hai tou Allah us kay mumlikat kay bashindon mein naqs dakhil kar deta hai , hatta keh bazaron, markton, ghallon, aur doodh (thanon mein) balkeh har cheez mein kami kardeta hai aur jab woh khairo bhalai ya adal ka iradah karta hai tou Allah isi tarah uski mumlikat kay bashindon mein barkat dakhil kardeta hai, hams kay aik governor Ne Umar bin Abdul Aziz ko khat likha:

Amma ba’ad! Sheher hams tou kharab ho Chuka hai, uski Islah ki zarurat hai.

Umar bin Abdul Aziz ne jawab likha:

“Use adal kay sath mehfuz rakho aur us kay raston ko zulm se saaf kardo”

Wassalam

Farmaya:
Qazi par haram hai keh woh ghusse ki halat mein faisla kare aur jab qazi mein qillate ilm, bura iradah, bure akhlaq aur qillate fatwa aur parhezgari jesi khaslaten jama’ hojaen tou uska khusran mukammal ho gaya, ab us par wajib hai keh woh apne aap ko ma’zool kare aur chutkara paane mein jaldi kare, pas ham Allah se afwo aafiat aur us kay pasandeedah umoor ki taufeeq ka sawal karte hain kyun keh woh sakhi daata fayyaz hai.

 

NASEEHAT:

 

ae woh shakhs keh jab uski umar ziada hui tou woh kam hui, ae maut kay farishte se be-khauf hone wale! Woh tou tera peecha kar raha hai, dunia ki taraf maail hone wale! Kia tum nuqs se mehfuz hogae ho? Apni umar mein hadd se barhne wale! Kia tumne milne wale mawaqe’ ki taraf jaldi ki hai? Ae woh shakhs! Jab bhi minhaje hidayat ki taraf taraqqi karta hai phir khuwahishat jhilmilane lagti hain tou woh peeche hat jata hai, hashar kay din jab naamahe aa’mal khulenge tou us waqt tera himayati kon hoga? Us nafs par ta’ajjub hai keh woh puri rat so kar guzar deta hai aur woh Qayamat ki holnakion ko bhul gaya agar mawa’iz ne use dastak di tou us kay kaan jhuk gae, phir zawajir usse nakaam laute, nufoos kareem kay karam mein tama’ karne wale ban gae aur woh kisi haal mein bhi us kay ita’at guzar na bane, iqdaame khuwahishat mein door daraz raston mein daur rahe hain, is kay ba’ad keh hidayat kay wasee’o kushada raste wazeh hogae, himmaton ne khuwahishat kay raston mein mutanaze’ wa alag raste bana lie hain, aqalmandon ki naseehaten un kay lie nafe’ na hui, dil is waqt taubah kay aadi hain jab kisi waqie aur rokne wale ki dant se ghabraen phir woh bar bar us cheez ki taraf laut’te hain jo halal nahin.

The Dishonest Judge

Allah Most High says, {And if any fail to judge by what Allah hath revealed, they are unbelievers.}

(AI-Ma’idah: 44)

{And if any fail to judge by what Allah hath revealed, they are wrong-doers.}

(AI-Ma’idah: 45)

{And if any do fail to judge by what Allah hath revealed, they are those who rebel.}

(AI-Ma’idah: 47)

In his Mustadrak, AI-Hakim reported on the authority of Talhah Ibn ‘Ubaid Allah (may Allah be pleased with him) that the Prophet (pbuh) said, “Verily, Allah never accepts the Prayer of a judge who judges with what Allah has not revealed.”¹

AI-Hakim reported also in his Sahih on the authority of Brada, (may Allah be pleased with him) that the Messenger of Allah (pbuh) said, “The judges are of three types: One type will go to Paradise and the remaining two will end up in the fire of Hell. The judge who will go to Paradise is one who understands the truth and judges accordingly. One who judges unjustly after understanding the truth will go to Hell. Likewise, the judge who judges in ignorance also will go to Hell. The Companions then asked, “What is the guilt of the ignorant one?” He (pbuh) replied, “Accepting the position of judge is his guilt until he gets a profound knowledge.”²

On the authority of Abu Hurairah that the Messenger of Allah (pbuh) said, “Whoever is appointed to be a judge as if he is slaughtered without a knife.”³

AI-Fudail Ibn ‘Eyad (may Allah bestow mercy on him) said, ‘the judge should spend a day in his job and a day in weeping over his own self.”

Muhammad Ibn Wasi’ (may Allah best our mercy on him) said, “On the Day of Judgment, the first of men who will be called to account are the judges.”

‘Aishah (may Allah be pleased with her) said, “I heard the Messenger of Allah say, “On the Day of Judgment, the just judge would face a great trial that he wishes if he were not appointed to judge between people even in the division of a palm-date.”⁴

`Ali Ibn Abi Talib (may Allah be pleased with him) said, “I heard the Messenger of Allah (pbuh) say,’On the Day of Judgment, no ruler or judge but be brought before Allah, Exalted and Dignified be He, over

the Sirat, then his deeds will be made public. If he was a just, Allah will save him. On the other hand, if he was unjust, the Sirat will strongly tremble to the extent that this one’s organs would be scattered,’ the distance between each organ would be such and such long and he will fall into Hell-Fire. “

Makhul, moreover, said, “If I were to choose between holding the position of a judge and beheading, I would surely prefer beheading over holding this job.”

Ayub Al-Sikhtiani further said, “The more knowledge the scholar get, the more their fear of holding the position of a judge increases.”

Having told that Shuraih was appointed to be a judge, AI- Thawri commented, “They would corrupt the man.”

It was narrated that Malik Ibn Al-Mundhir appointed Muhammad Ibn Wasi’, to be the judge of Basra.

When Muhammad objected, Malik warned him that he would flog him if he insisted on his objection. On hearing that Muhammad disclosed, “If you do, you will be a tyrannical ruler. However, I prefer humiliation in this world over the torment in the world to come.” Wahb Ibn Manabah said, “The more just the ruler is, the more blessing on his people Allah will descend.”

A worker wrote to `Umar Ibn `Abd AI-`Aziz, “O ‘Umar! The city of Hims has been destroyed and therefore it is in need of rebuilding.” `Umar (may Allah be pleased with him) replied, “Fortify it with justice and clean its roads from oppression.”

However, the scholars of Islam state that the judge should not utter a judgment when he is angry,anxious or nervous. Furthermore, if a man of ignorance or immorality is appointed to be a judge, he should resign and leave the office.
