Bahwas-e-Al-‘Ilmiya-o-Al-Iftaa ki fatwa-e-commity key paas yeh sawaal aaya key merey mulk mein ba’az log ghair Allah ki ‘ibaadat kartey hai aur unki ek ‘aadat yeh bhi hai key un mein sey jab koi insaan fout ho jata hai to woh ek makhsoos tareeqe sey us key liye gaaye Bakri ya koi aur paaltu jaanwar zabah kartey hain aur us ka gosht apney ird gird key logon bashamool musalmaanon mein taqseem kar detey hain lekin musalmaan us gosht ko qubool karney sey inkaar kartey aur kehtey hain key yeh Haraam hai to phir woh musalmaanon ko gaaye waghaira zindah jaanwar hi detey hain aur kehtey hain key yeh jaanwar lelo aur iss sey apney tareeqey sey zabah karlo taakey yeh us mayyat ki taraf sey sadqa ho jo key ghair Allah ki ‘ibaadat karta raha hai. Sawaal yeh hai key us jaanwar ko lekar Islami tareeqey sey zabah kar key us key gosht ko musalmaanon mein taqseem karna jaaiz hai ya nahin? Kya yeh ‘amal unkey kaam mein shirkat samjha jaye ga? (Jazakum Allah kharan)
[Jawab] Ghair Allah ki ‘ibaadat karna aur murdon, Ghaib logon aur darakhton aur deegar ghair Allah key naam ki nazar maanna ya un sey madad talab karna shirk hai. Woh shakhs bohat acha karta hai jo gaaye bakri waghaira key us gosht ko qubool karney sey inkaar kar deta hai jis sey ghair Allah key pujari apney murdon key naam par zabh kartey hain. Haan albata us zindah gaaye aur bakri key leney mein koi harj nahin jis sey un sey lekar Islami tareeqe key mutabiq zabah kar liya jaaye basharteka zabh key waqt ka murda ki wafaat key waqt sey ta’aluq na ho. Na unki bidd’at mein shirkat ho aur na zabah karney aur gosht taqseem karney sey maqsood-e-mayyat par sadqa karna ho jab key mayyat ghair Allah ki ‘ibaadat karney walon mein sey ho aur agar musalmaan us jaanwar ko uski mout key waqt ya us key janazah key ley jaaney key waqt zabah karen to jaaiz na ho ga kyunki us mein unki bidd’at mein shiraakat ho gi.

__Fatwa-e-Commity__
Q)Some people in my country worship other than Allah, Glorious is He. They have a traditional custom that whenever a person dies they kill a cow or a sheep or any animal. After killing it, they distribute its meat among some Muslims who live around them. But those Muslims refuse to accept it, saying it is unlawful. Thereupon they told those Muslims, “Take a cow and kill it in your own way, so that it will be a charitable gift on behalf of the dead person,’ who worshipped other than Allah, the Exalted. Is it permissible for us to take that cow and slaughter it, according to our Islamic ritual, and distribute its meat to Muslims, or not? Would ‘accepting’ a cow on our part be considered as participating in their customs?
A)Worshipping other than Allah in terms of making vows, or seeking aid from other than Allah, from dead, absent people, trees, or the like constitutes Shirk.
Those who refused to take the meat of cows that are slaughtered by those who do not worship Allah, for their dead, did the right thing. There is no harm in taking live cows to be slaughtered according to the Islamic method, without intending slaughtering it at the time of the death of that person. This is not considered as taking part in their innovation, and should not be intended as an act of charity on behalf of the dead person, if such a person worshipped other than Allah. If they intend timing its slaughter with the death of that person, and join the procession of the funeral, then it would not be permissible to accept such animal, because it will be considered as sharing their innovation. May Allah exalt the mention of our Prophet Muhammad, his household, and Companions and render them safe from evil.

*مردوں کے لئے ذبح کرنے کا حکم*
بحوث العلمیة والافتاء کی فتویٰ کمیٹی کے پاس یہ سوال آیا کہ میرے ملک میں بعض لوگ غیر اللہ کی عبادت کرتے ہیں اور ان کی ایک عادت یہ بھی ہے کہ ان میں سے جب کوئی انسان فوت ہو جاتا ہے تو وہ ایک مخصوص طریقہ سے اس کے لئے گائے، بکری یا کوئی اور پالتو جانور ذبح کرتے ہیں اور اس کا گوشت اپنے اردگرد کے لوگوں بشمول مسلمانوں میں تقسیم کر دیتے ہیں لیکن مسلمان اس گوشت کو قبول کرنے سے انکار کرتے اور کہتے ہیں کہ یہ حرام ہے تو پھر وہ مسلمانوں کو گائے وغیرہ زندہ جانور ہی دیتے ہیں اور کہتے ہیں کہ یہ جانور لے لو اور اسے اپنے طریقے سے ذبح کر لو تاکہ یہ اس میت کی طرف سے صدقہ ہو جو کہ غیر اللہ کی عبادت کرتا رہا ہے۔ سوال یہ ہے کیا اس جانور کو لے کر اسلامی طریقہ سے ذبح کر کے اس کے گوشت کو مسلمانوں میں تقسیم کرنا جائز ہے یا نہیں؟ کیا یہ عمل ان کے کام میں شرکت سمجھا جائے گا؟

غیر اللہ کی عبادت کرنا اور مردوں، غائب لوگوں اور درختوں اور دیگر غیر اللہ کے نام کی نذر ماننا یا ان سے مدد طلب کرنا شرک ہے۔ وہ شخص بہت اچھا کرتا ہے جو گائے، بکری وغیرہ کے اس گوشت کو قبول کرنے سے انکار کر دیتا ہے جسے غیر اللہ کے پجاری اپنے مردوں کے نام پر ذبح کرتے ہیں، ہاں البتہ اس زندہ گائے اور بکری کے لینے میں کوئی حرج نہیں جسے ان سے لے کر اسلامی طریقہ کے مطابق ذبح کر لیا جائے بشرطیکہ ذبح کے وقت کا مردہ کی وفات کے وقت سے تعلق نہ ہو نہ ان کی بدعت میں شرکت ہو اور نہ ذبح کرنے اور گوشت تقسیم کرنے سے مقصود میت پر صدقہ کرنا ہو جب کہ میت غیر اللہ کی عبادت کرنے والوں میں سے ہو اور اگر مسلمان اس جانور کو اس کی موت کے وقت یا اس کے جنازہ کے لے جانے کے وقت ذبح کریں تو جائز نہ ہو گا کیونکہ اس میں ان کی بدعت میں شراکت ہو گی۔
