‘Aurat ko haath lagane se Wuzu nahi toot’ta

[Sawaal]

Agar darmiyaan mein kisi cheez ke haail hue baghair koi aadmi kisi ajnabi ‘Aurat ko haath lagaata hai to us ke liye shariy’at ka Kia hukm hai? Kia is se Wuzu toot jaae ga ya nahi? Nez yeh bataaiye ke ajnabi ‘Aurat se Kia maqsood hai?

[Jawab]

Ahl-e-ilm ke sahih tareen qawl ke mutaabiq ‘Aurat ko haath lagaane se Wuzu nahi toot’ta kyunke Hadees se saabit hai ke:

أَنَّهُ قَبْلَ بَعْضَ نِسَائِهِ ثُمَّ صَلَّى وَلَمْ يَتَوَضَّا

(Sunan Abi Dawood, Kitaab Al-Tahaarat, Baab Al-Wuzu min Al-Qibla, H: 178, 179, -o-Jaam’a Al-Tirmizi, Kitaab Al-Tahaarat, Baab maa jaa fi tark Al-Wuzu min Al-Qibla, H: 86)

“Nabi Kareem ne azwaaj-e-mutaaharat mein se kisi ko bosa diya phir Namaz padhi aur Wuzu na kiya.”

Lekin ‘Aurat ke liye yeh jaaiz nahi hai ke woh kisi ghair mehram ke saath musaafaha kare aur na mard ke liye yeh jaaiz hai ke woh kisi ghair mehram ‘Aurat ke saath musaafha kare.

Nabi (ﷺ) ka Irshaad-e-Giraami hai ke:

إِنِّي لا أَصَافِحُ النِّسَاءَ

“Mein ‘Aurton se musaafaha nahi karta.”

(Sunan Al-Nisa’i, Kitaab Al-Bai’at, Baab Bai’at Al-Nisaa, H: 4186, -o-Al-Muwatta Malik-bin-Anas, Kitaab Al-Bai’at, Baab maa jaa fi Al-Bai’at, H: 2)

(1) Imaam Shawkani رحمة الله farmaate hain ke:

أنَّ الرِّوَايَة لِكُلِّ صَلَاةٍ لَا لِوَقْتِ كُل صلاة

“Riwaayat ke alfaaz yeh hain ke har Namaz ke liye Wuzu karo. Yeh alfaaz nahi hain ke har Namaz ke waqt ke liye Wuzu karo.” (Neel Al-Awtar, Jild: 1′ Safha: 275) Imaam Shawkani رحمة الله ki yeh baat durust hai.

Hazrat Ayesha رضي الله عنها se riwaayat hai ke:

أَنَّ النَّبِيَّ ، كَانَ يُبَايِعُ النِّسَاءَ بِالْكَلَامِ فَقَطْ قَالَتْ: وَمَا مَسَّتْ يَدُهُ يَدَ إِمْرَأَةٍ قط

“Nabi Kareem (ﷺ) ‘Aurton se sirf hum kalaam ho kar bi’at liya karte the aur kabhi bhi kisi ‘Aurat ke haath ko Aap (ﷺ) ka haath nahi laga tha.”

Aur Allah ka farmaan hai:

لَقَدۡ كَانَ لَكُمۡ فِىۡ رَسُوۡلِ اللّٰهِ اُسۡوَةٌ حَسَنَةٌ

(Al-Ahzab 33 21)

“Yaqeenan tumhare liye Rasoolullah (ﷺ) ki zaat mein behtreen aur umdah namoona maujood hai.”

“‘Aurton ka ghair mehram mardon se aur mardon ka ghair mehram ‘Aurton se musaafaha sab ke liye fitna ka sabab hai aur kamil tareen Islami shariy’at aai hi isliye hai ke un tamaam zaraae ko band kar de jo un umoor tak pohanchaate hain, Jinhein Allah ne Haraam qaraar diya hai.

Is se yeh bhi ma’loom ho gaya ke ajnabi ‘Aurat se muraad woh ‘Aurat hai ke jis ke aur mard ke darmiyaan nasab ya kisi doosre mubah sabab ke baa’is koi aisa rishta na ho jis ki wajah se woh us ke liye Haraam ho maslan: maa’ Behn’ Phoophi waghaira ya kisi shar’i sabab ki wajah se Haraam hai. Maslan: Razaa’at-o-musaaharat waghaira to aisi ‘Aurtein ajnabi nahi hain. Wa billahi Al-Toufeeq!
