Haaiza ke liye Masjid se mulhiqa hisson mein daakhila

[Sawaal]

America mein ek Masjid ki teen manzilen hain. Upar ki manzil ‘Aurton ki Namaz ke liye hai aur us ke neeche ki manzil asli Masjid hai aur us ke neeche ki jo manzil hai us mein Wuzu aur ghusl ki jagah Majalaat aur Islami jaraaid-o-akhbaaraat ke liye jagah aur ‘Aurton ki ta’leem aur Namaz ke liye jagah banaai gai hai. Kia us sab se nichli manzil mein haaiza ‘Aurton ke liye daakhla jaaiz hai Nez Masjid mein aise sutoon banaae gae hain jo Namaaziyon ki Safon ke darmiyaan mein aa jaane se sif ke do hisse ho jaate hain, Kia is se sif toot’ti to nahi hai?

[Jawab]

Jab mazkoora baala ‘imaarat ko Masjid ke liye banaaya gaya hai aur upar aur neeche ki dono manzilon waale Imaam ki awaaz ko sunte hain to sab ki Namaz sahih hai. Aur haaiza khawaateen ke liye us jagah bethna jaaiz nahi, Jis se nichli manzil mein khawaateen ki Namaz ke liye makhsoos kiya gaya hai kyunke yeh jagah Masjid ke taab’a hai aur Nabi Kareem (ﷺ) ne farmaaya hai ke:

إِنِّي لَا أُحِلُّ الْمَسْجِدَ لِحَائِضِ وَلَا جُنُب

(Sunan Abi Dawood, Kitaab Al-Tahaarat, Baab fi Al-Janab Yadkhal al-Masjid, H: 232)

“Mein haaiza aur jumbi ke liye Masjid ko Halaal qaraar nahi deta.”

Haan albatta ba’az zaroorat ke pehlu se haaiza ke liye Masjid se guzarna jaaiz hai is ehtiyaat ke saath ke khoon na gire.

Irshaad-e-Baari Ta’ala hai:

وَلَا جُنُبًا اِلَّا عَابِرِىۡ سَبِيۡلٍ

(Al-Nisaa 443)

“Aur janaabat ki haalat mein bhi qareeb na jaao illa yeh ke raaste chale jaa rahe ho.”

Aur Hadees se saabit hai ke Nabi (ﷺ) ne Hazrat Ayesha رضي الله عنها ko hukm diya ke woh Aap (ﷺ) ko Masjid se musala laa dein to unhon ne ‘arz kiya ke woh haaiza hain to Nabi (ﷺ) ne farmaaya:

إِنَّ حَيْضَتَكِ لَيْسَتْ فِي يَدِكِ

“Bilaashuba tumhara haaiz tumhare haathon mein to nahi hai.”

(Sahih Muslim, Kitaab Al-Haiz, Baab Jawaaz ghusl Al-Haiz Raas Zawja, H: 298, -O-Masnad Ahmad 2 86, 6 45)

Nichli manzil waqf karne waale ne agar Masjid ki niyyat na ki ho balkeh us ke store banaane ya deegar zarooriyaat ke iste’maal ke liye jaisa ke sawaal mein bayaan kiya gaya hai, Niyyat ki ho to yeh jagah Masjid ke hukm mein na ho gi Us jagah haaiz-o-jumbi ke liye bethna jaaiz ho ga aur is hissa mein Namaz padhne mein bhi koi harj nahi bashart ye ke woh jagah tahaarat khaanon ke taab’a na ho, Jis tarah baaqi paak maqaamaat par Namaz padhi jaa sakti hai, Yahan bhi padhi jaa sakti hai lekin yahan Namaz padhne waala upar ki manzil mein Namaz padhaane waale Imaam ki iqtida nahi kare ga jab ke woh us se ya ba’az Namaaziyon ko na dekh sakta ho kyunke ‘Ulama ke raajeh qawl ke mutaabiq us soorat mein yeh jagah Masjid ke taab’a na ho gi. Safon ke darmiyaan mein waqiy’a-e-sutoonon se Namaz ko koi nuqsaan nahi pohanchta haan agar yeh mumkin ho ke sif ko sutoonon se aage ya peeche bana liya jaae aur woh darmiyaan mein haail na hon to yeh afzal aur akmal hai.
