Doosri jama’at ka hukm

[Sawaal]

Jo log jama’at se peeche reh jaaein aur Masjid mein aaein aur dekhen ke log Namaz padh chuke hain, To Kia woh usi Masjid mein doosri jama’at karwa sakte hain? Kia is Hadees ke(من يتصدق علی ھذا) “Kon hai jo is par sadqa kare?” aur Ibn Mas’ood رضی اللہ عنہ ya kisi doosre Sahaabi ka yeh qawl hai ke “Jab hamari jama’at reh jaati to hum alag alag Namaz padhte” mein ta’arruz hai?

[Jawab]

Jo shakhs Masjid mein aae aur dekhe ke log Imaam-e-Ratib ya Ghair Ratib ki iqtida mein jama’at se faarigh ho chuke hain to woh un logon ke saath shaamil ho kar jin ki jama’at reh gai hai, Namaz ba jama’at adaa kar le ya un mein se koi us par sadqa karte hue us se jama’at se Namaz padha de, Jo pehle apni Namaz jama’at ke saath adaa kar chuke hon kyunke Hazrat Abu Sa’eed Khadri رضی اللہ عنہ se riwaayat hai ke Rasoolullah (ﷺ) ne ek shakhs ko tanha Namaz padhte hue dekha to farmaaya:

أَلَا رَجُلٌ يَتَصَدَّقُ عَلَى هَذَا فَيُصَلِّي مَعَهُ

(Sunan Abi Dawood, Kitaab Al-Salaat, Baab: fi Al-Jam’a fi Al-Masjid marateen, H: 574)

“Kia koi hai jo us shakhs par sadqa kare aur us se Namaz ba jama’at ke saath padha de?”

To ek shakhs khada hoa aur us ne us se Namaz padha di. Tirmizi ne bhi Hazrat Abu Sa’eed Khadri رضی اللہ عنہ se riwaayat kiya hai ke ek aadmi us waqt aaya jab Rasoolullah (ﷺ) hamein Namaz padha chuke the, To aap ne farmaaya:

أَيُّكُمْ يَتَّجِرُ عَلَى هَذَ

(Sunan Tirmizi, Kitaab Al-Salaat, Baab maa jaa fi Al-Jama’at fi Masjid qad sulli fihi marat, H: 220)

“Kon hai jo is se tijaarat kare?”

Ek aadmi khada hoa aur us ne us se Jama’at se Namaz padha di. Imaam Tirmizi farmaate hain ke yeh Hadees-e-Hassan hai. Imaam Haakim ne bhi iss se riwaayat kiya aur sahih qaraar diya hai aur Imaam Zehbi ne aap ki muwaafiqat ki hai. Imaam Ibn-e-Hazam رحمة الله ne bhi “Al-Muhalla” mein is ka zikr kar ke us ki sehat ki taraf ishaarah kiya hai. Imaam Tirmizi farmaate hain ke “Kayi ek Sahaaba-o-tabi’een ka yehi qawl hai ke us Masjid mein dobaraah Jama’at ke saath Namaz padhne mein koi harj nahi, Jis mein pehle Jama’at ho chuki ho.”

Imaam Ahmad aur Ishaq ka bhi yehi qawl hai. Kuch doosre logon ka qawl yeh hai ke un logon ko Namaz alag alag padhni chaahiye. Chunaanche Sufyan’ Ibn-e-Al-Mubarik , Maalik aur Imaam Shaafi’i ka yehi qawl hai ke un logon ko Namaz alag alag padhni chaahiye. Aur un ke humnawa logon ne doosri Jama’at ko is liye makrooh qaraar diya hai ke is se iftiraaq aur intashaar paida ho ga. Khwahish-e-nafs ke pujaari Jama’at se peeche reh jaane ka iss se ek zariy’a bana lein ge aur is tarah doosri Namaz us Imaam ki iqtida mein adaa karen ge, Jo un ki Jama’at aur un ki bidd’at mein un ki muwaafiqat kare ga lekin mazkoora baala Hadees ke pesh-e-nazar in mein se pehla qawl hi sahih hai.

Irshaad-e-Baari Ta’ala hai:

فَاتَّقُوا اللّٰهَ مَا اسۡتَطَعۡتُمۡ

(Al-Taghaban 6416)

“So jahan tak ho sake. Tum Allah se daro.”

Ke ‘umoom ka bhi yehi taqaaza hai, Nez Nabi (ﷺ) ke is Irshaad ke:

إِذَا أَمَرْتُكُمْ بِأَمْرٍ فَانْتُوا مِنْهُ مَا اسْتَطَعْتُمْ

(Sahih Muslim, Kitaab Al-Hajj, Baab Farz Al-Hajj marat fi Al-‘Umar, H: 1337, -o-Masnad Ahmad, 2 2 , 508)

“Jab mein tumhein koi hukm doon to maqdoor bhar us ki ita’at baja laao”

Ke ‘umoom ka taqaaza bhi yehi hai. Bilaashak-o-shuba Namaz ba jama’at adaa karna hi taqwa hai aur shariy’at ne is ka hukm diya hai. lehaaza maqdoor bhar koshish ke saath us se adaa karna chaahiye aur yeh bhi sahih nahi ke sahih Ahadees ke mu’aariza mein Ahl-e-ilm ki un bayaan kardah ‘alal ko pesh kiya jaae, Jin ki wajah se unhon ne Masjid mein doosri jama’at ko makrooh qaraar diya hai balkeh us ke mutaabiq ‘amal karna waajib hai, Jis par sahih naqaul dalaalat kanan hon aur agar kisi shakhs ya kisi jama’at ke baare mein yeh baat ma’loom ho jaae ke woh Namaz ba jama’at ko ahmiyat na dene ki wajah se daanista peeche rehte hain aur un se baar baar is baat ka sadoor hoa hai ya un ke tarz-e-‘amal aur un ki jama’at ki rawish se yeh zaahir ho ke mehez is liye jama’at se peeche rehte hain taake apne humnawa logon ke saath Namaz adaa karen, To unhein t’azeeri saza di jaae gi aur is baat se unhein roka jaae ga. Musalmaan haakim unhein aur un jaise apni khuwahish ke bachaariyon ko jo chaahe munaasib saza de sakta hai aur is tarah inteshaar-o-khalafshaar aur khuwaahishat ke pujaariyon ki aghraaz ka sad-e-baab kiya jaa sakta hai lehaaza un dalaail ko tark karne ki zaroorat nahi, Jin se un logon ke liye doosri jama’at ke jawaaz ka saboot milta hai, Jo pehli jama’at se mehroom ho gae hon.
