Kya aurat k liye koi aisi umer hai jis mein usay mehram ki zaroorat nahi rehti?
Meri umer arrtees (38) baras hai meri abhi tak shadi nahi hui aur main teacher hun, mere waalid sahab faut ho chuke hain, aur main ghar k akhraajaat mein kisi hadd tak waalida ka hath bataati hun, meri hajj ki khuwaahish thi is liye hajj ki darkhuwast di aur quraa’ andaazi mein naam nikal aaya lekin mujhe mehram ki zaroorat hai, aur bhai apna kharch bardaasht nahi kar sakta, mujhe ilm hai k main is ka kharch bardaasht karun lekin mere pas jo raqam hai mujhe mustaqbil mein is ki zaroorat hai, is liye main ne faisla kiya hai k main farzi hajj ko us umer tak muakhar kar dun jis mein mehram ki zaroorat nahi rehti, aisa karne ki kya sazaa hai?
Guzaarish hai k mujhe is k mutalliq maaloomat faraaham karain kyunk mujhe bhtt qulaq hai.

Alhamdulillah.
Awwal:
Jis k pas istitaa’at na ho us par hajj farzz nahi hota kyunk Allah Ta’ala ka farmaan hai:
“Aur logo par Allah k liye Bait Ullah ka hajj karna farzz hai jo koi istitaa’at rakhe”.
(Ale Imran-97)
Aur aurat ki munaasibat se is ki istitaa’at mein yeh shaamil hai k is k pas mehram ho jo is k sath safar mein is k sath jaey, aur agar wo mehram nahi paati to us par hajj farzz nahi hoga.
Mustaqil Fatwa Comittee k Fatawaa jaat mein hai keh:
Hajj ki shuroot mein istitaa’at bhi hai, aur aurat k liye mehram ka hona istitaa’at mein se hai, is liye jab aurat ka mehram na ho to us k liye safar karna jaaiz nahi, aur us par hajj us waqtt waajib hoga jab mehram ho aur mehram us k sath safar karne par bhi muwaafiq ho.
Allah Ta’ala ka farmaan hai:
“Aur logo par Allah Ta’ala k lye Bait ullah ka hajj karna farzz hai jo us ki istitaa’at rakhe “.
(Aal e Imran-97)

Doum:
Koi aisi umer nahi jis mein aurat mehram ki muhtaaj na rahe, balke wo balooghat k baad saari umer mein mehram k baghair safar nahi kar sakti, aur is mein burhi aur jawaan aurat mein koi farqq nahi, is ki daleel Nabi Kareem (ﷺ) k darj zail farmaan ka mafhoom hai:
“Aurat mehram k baghair safar na kare”.
Sahih Bukhari aur Sahih Muslim.
Is ka bayaan sawal no: 47029 aur 25841 k jawaabat mein guzar chuka hai, us ka mutaall’a karain.
Soum:
Agar aurat ko mehram mil jaey to us ka kharch aurat par waajib hai.
Imam Qudaama (رحمة الله) kehte hain keh:
“Hajj mein mehram ka kharch aurat kay zimme hai,
Imam Ahmed (رحمة الله) ne yehi bayaan kiya hai, kyunk yeh is ki raah mein shamil hai to is tarah sawaari ki tarah mehram ka kharch bhi aurat k zimme hoga, to is bina par is ki istitaa’at mein yeh shaamil hoga k aurat apne aur apne mehram ki sawaari ki maalik ho”.
Dekhen: Al Mughni Li Ibn Qudaamah (99/3).
Aur Surkhsii (رحمة الله) kehte hain:
Agar aurat ka mehram is k sath jaey to us ka kharch aurat k maal se kiya jaega”.

Chahaaram:
Kharch ki raqam ki zaroorat ki bina par aap ka hajj ko muakhar karne k mutaliq aap sawal no: 11534 k jawab ka mutaall’a karain.

Is there an age at which a woman no longer needs a mahram?
Question
I am a single woman aged 38. I am a teacher and I have not got married yet. My father has passed away, and I help my mother to some extent with household expenses. I want to perform Hajj, and my name was drawn in the “lottery” (to select who can go for Hajj) but I need a mahram. My brother does not have enough money to spend on his own expenses. I know that I should pay for him, but I need the money for my future needs. So I have decided to delay this obligatory duty until I reach an age when I no longer need a mahram. Will I punished for my decision? I hope you can answer me because I am very anxious.
Answer
Praise be to Allah.
Firstly:
Hajj is only obligatory for those who are able to do it, because Allaah says (interpretation of the meaning):
“And Hajj (pilgrimage to Makkah) to the House (Ka‘bah) is a duty that mankind owes to Allaah, those who can afford the expenses”
[Aal ‘Imraan 3:97]
One of the conditions of being able to do it for a woman is that she should have a mahram who agrees to go with her. If she cannot find a mahram then she is not obliged to perform Hajj.
It says in Fataawa al-Lajnah al-Daa’imah (11/93): One of the conditions of Hajj being obligatory is that one should be able to do it, which includes having a mahram for women. If a woman does not have a mahram then she is not permitted to travel, and she is not obliged to perform Hajj unless she has a mahram and he agrees to travel with her. Allaah says (interpretation of the meaning):
“And Hajj (pilgrimage to Makkah) to the House (Ka‘bah) is a duty that mankind owes to Allaah, those who can afford the expenses”
[Aal ‘Imraan 3:97]

Secondly:
There is no age at which a woman does not need a mahram, rather at all ages of her life after she reaches puberty it is not permissible for her to travel without a mahram. No distinction is made between young women and old women, because the Prophet (peace and blessings of Allaah be upon him) said: “No woman should travel except with a mahram.” Narrated by al-Bukhaari and Muslim.

Thirdly:
If a woman has a mahram, she has to spend on him.
Ibn Qudaamah (may Allaah have mercy on him) said:
She has to spend on her mahram’s expenses during Hajj, as was stated by Ahmad, because this is part of her being able to perform Hajj. So she has to spend on his expenses such as travel. Based on this, part of her ability to perform Hajj is that she should be able to afford provisions and travel expenses for herself and for her mahram.

Al-Sarkhasi said:
If a mahram travels with her then she should spend on him from her own wealth.

Fourthly:
With regard to your delaying Hajj because you need the money, please see question no. (11534).

ميرى عمر اڑتيس برس ہے ميرى ابھى تك شادى نہيں ہوئى اور ميں ٹيچر ہوں، ميرے والد صاحب فوت ہو چكے ہيں، اور ميں گھر كے اخراجات ميں كسى حد تك والدہ كا ہاتھ بٹاتى ہوں، ميرى حج كى خواہش تھى اس ليے حج كى درخواست دى اور قرعہ اندازى ميں نام نكل آيا ليكن مجھے محرم كى ضرورت ہے، اور بھائى اپنا خرچ برداشت نہيں كر سكتا، مجھے علم ہے كہ ميں اس كا خرچ برداشت كروں ليكن ميرے پاس جو رقم ہے مجھے مستقبل ميں اس كى ضرورت ہے، اس ليے ميں نے فيصلہ كيا ہے كہ ميں فرضى حج كو اس عمر تك مؤخر كردوں جس ميں محرم كى ضرورت نہيں رہتى، ايسا كرنے كى سزا كيا ہے ؟
گزارش ہے كہ مجھے اس كے متعلق معلومات فراہم كريں كيونكہ مجھے بہت قلق ہے.
جواب کا متن
الحمد للہ.
اول:
جس كے پاس استطاعت نہ ہو اس پر حج فرض نہيں ہوتا، كيونكہ اللہ سبحانہ وتعالى كا فرمان ہے:
اور لوگوں پر اللہ كے ليے بيت اللہ كا حج كرنا فرض ہے جو كوئى اس كى استطاعت ركھےآل عمران ( 97 ).
اور عورت كى مناسبت سے اس كى استطاعت ميں يہ شامل ہے كہ اس كے پاس محرم ہو جو اس كے ساتھ سفر ميں اس كے ساتھ جائے، اور اگر وہ محرم نہيں پاتى تو اس پر حج فرض نہيں ہو گا.
مستقل فتوى كميٹى كے فتاوى جات ميں ہے كہ:
حج كى شروط ميں استطاعت بھى ہے، اور عورت كے ليے محرم كا ہونا استطاعت ميں سے ہے، اس ليے جب عورت كا محرم نہ ہو تو اس كے ليے سفر كرنا جائز نہيں، اور اس پر حج اس وقت واجب ہو گا جب محرم ہو اور محرم اس كے ساتھ سفر كرنے پر بھى موافق ہو.
اللہ تعالى كا فرمان ہے:
اور لوگوں پر اللہ تعالى كے ليے بيت اللہ كا حج فرض ہے جو اس كى استطاعت ركھے آل عمران ( 97 ).

دوم:
كوئى ايسى عمر نہيں جس ميں عورت محرم كى محتاج نہ رہے، بلكہ وہ بلوغت كے بعد سارى عمر ميں محرم كے بغير سفر نہيں كر سكتى، اور اس ميں بوڑھى اور جوان عورت ميں كوئى فرق نہيں، اس كى دليل نبى كريم صلى اللہ عليہ وسلم كے درج ذيل فرمان كا عموم ہے:
” عورت محرم كے بغير سفر نہ كرے “
صحيح بخارى اور صحيح مسلم.
اس كا بيان سوال نمبر ( 47029 ) اور ( 25841 ) كے جوابات ميں گزر چكا ہے اس كا مطالعہ كريں.
سوم:
اگر عورت كو محرم مل جائے تو اس كا خرچ عورت پر واجب ہے.
ابن قدامہ رحمہ اللہ تعالى كہتے ہيں:
حج ميں محرم كا خرچ عورت كے ذمہ ہے، امام احمد رحمہ اللہ تعالى نے يہى بيان كيا ہے، كيونكہ يہ اس كى راہ ميں شامل ہے، تو اس طرح سوارى كى طرح محرم كا خرچ بھى عورت كے ذمہ ہو گا، تو اس بنا پر اس كى استطاعت ميں يہ شامل ہو گا كہ عورت اپنے اور اپنے محرم كى سوارى كى مالك ہو”

اور سرخسى رحمہ اللہ تعالى كہتے ہيں:
اگر عورت كا محرم اس كے ساتھ جائے تو اس كا خرچ عورت كے مال سے كيا جائيگا”
