(10) TAMAM GHAIR MAAKOOL-UL-LAHAM JANWARON KAY PISHAAB KO NAJAS QARAAR DENA DORUST NAHI:

 

 

(1) Kiyonkeh is ki koi wazih daleel maujood nahi.

 

(2) Aur jo riwaayat is ziman mein paish ki jati hai

” لا بأس ببول ما اکل لحمه “

” Maakool-ul-laham janwaron kay pishaab mein koi haraj nahi hai “

Woh sakhat za’eef-o-na’qabil-e-hujjat hai,

Kiyonkeh is ki sanad mein “Siwaar ibn-e-mus’ab” raawi za’eef hai,

Jaisa keh Imam Bukhari ( رحمه الله ) nay usay “munkar-ul-hadith” aur Imam Nasaayi ( رحمه الله ) nay  usay matrook qaraar diya hai.(1).

 

Lihaza raajih baat yeh hi hai keh yaqeeni taur par sirf insaan kay baul-o-baraaz ki najaasat par hi iktefaa kiya jaye’

is kay ilawah baqiyah haiwanaat mein say jis kay baul-o-baraaz kay muta’allaq taharat ya najaasat ka hukam sareeh nass say saabit ho jaye usay ussi hukam kay sath mulhaq kar diya jaye,

Aur agar aisi koi daleel na milay to asal ( taharah ) ki taraf rujoo karna hi ziyadah dorust aur qareen-e-qiyas hai.(2)

 


[[[[ وَلُعَابُ كَلۡبٍ]]]]


” Aur kutay ka lu’aab-e-dahan ( najas hai ){1}.


 

{1} Jaisa keh Sayyiduna Abu Hurairah ( رضی الله عنه ) say marwi hai keh Rasoolullah ﷺ nay farmaya

” اذا ولغ الکلب فی اناء احدکم فلیرقه ثم لیغسله سبع مرات اولاھن بالتراب “

” Jab tum mein say kisi kay bartan mein kuta munh daal jaye to usay ( pani ko ) bahaa dena chahiye, Aur bartan ko 7 martabah dhona chahiye, Albattah pahli martabah matti kay sath dhoya jaye,

Aur jaami tirmazi mein yeh alfaz hain:

” اخراھن أو أولاھن بالتراب “

” Aakhiri martabah ya pahli martabah matti kay sath dhoya jaye “(3)

 

Kuta ba’zaat-e-khud aur us ka lu’aab wahan najas hai ya nahi ?

 Is mein fuqaha nay ikhtelaaf kiya hai.

 

( SHAFI’EIYAH-O-HANABILAH )

Kuta aur us say kharij honay wali har cheez masalan: us ka lu’aab aur pasinah waghairah sub najas hai.

In ki daleel guzishtah hadees hai.(4)

 

( MALIKIYAH )

Na to kuta ba’zaat-e-khud najas hai aur na hi us ka lu’aab, Aur jis bartan mein kuta munh daal jaye usay dhonay ka hukam ta’abbudi hai na keh najaasat ki wajah say.(5)



( AHNAAF )

Sirf kutay ka munh, uska lu’aab  aur us ka pa’khana waghairah najas hai, Kuta ba’zaat-e-khud najas nahi, Kiyonkeh us say pahrah daari aur shikaar ka kaam liya jata hai.(6)

 

( JAMHOOR FUQAHA )

Kutay ka lu’aab guzishtah hadith ki bina par najas hai,

Is say saabit huwa keh uska munh bhi najas hai, Kiyonkeh lu’aab munh ka aik juz’u hai’ Aur jab jisam ka sub say ashraf juz’u ( munh ) najas hai to baqiyah jisam ka najas hona to bil’aula zaruri hai.(7)

 

( IMAM IBN-E-TAIMIYAH ( رحمه الله )

Kutay ka lu’aab nass ki wajah say najas hai, Us kay baiqiyah tamam ajzaa qiyas ki wajah say najas hain, Albattah us kay baal paak hain.(8)

 

( IMAM SHAUKANI  ( رحمه الله )

Hadith ki wajah say sirf kutay ka lu’aab najas hai, Us kay ilawah us ki baqiyah  mukammal zaat ( yaani haddiyan, gausht, khoon, baal aur paseenah waghairah  ) paak hai, Kiyonkeh asal tahaarat hai,

Aur uski zaat kay najaasat kay muta’aalaq koi daleel maujood nahi.(9)

 

( RAAJIH )

Imam Shaukani ( رحمه الله ) ka mo’aqqaf raajih maloom hota hai, Wallaho Aalam.

 

Jis bartan mein kuta munh daal jaye usay 7 martabah dhona waajib hai,

Jaisa keh guzishtah hadith mein ap ka yeh hukam maujood hai.

 

( IMAM AHMAD, IMAM SHAFIE, IMAM MALIK ( رحمھم الله )

Issi kay qaail hain.

Sayyiduna Ibn-e-abbas, Sayyiduna Urwah ( رضی الله عنھما ) Imam Ibn-e-sireen, Imam Taaus, Imam Amar ibn-e-dinaar, Imam Auzayi, Imam Is’haque, Imam Abu Saur, Imam Abu Ubaid aur Imam Daud ( رحمھم الله ) waghairah sub ka issi ki taraf melaan-o-ruj’haan hai.

 

( AHNAAF )

7 martabah dhona mustahab hai, Aur agar 3 martabah hi dho liya jaye to kafi hai.(10)

 

(1) Unki daleel Sayyiduna Abu Hurairah ( رضی الله ) ka yeh qaul hai:

” ثم اغسله ثلاث مرات “

” Phir usay 3 martabah dho lo “(11)

Yaani raawi-e-hadith ka amal apni hi riwaayat kardah marfu hadith kay mukhaalif hai, Lihaza is par amal karna waajib nahi.

Is ka jawab youn diya gaya hai keh Allah kay Rasool ﷺ kay farman kay muqabilay mein kisi ki baat qubool nahi ki jaye gi, neez Sayyiduna Abu Hurairah ( رضی الله عنه ) say 7 martabah dhonay ka fatwa bhi manqool hai.(12)

 

(2) Ahnaaf ka yeh mustadal bhi hai keh pa’khana kutay kay jhutay say ziyadah najas hai, Lekin jab usay 7 martabah dhonay ki qaid nahi lagayi gayi to is mein bil’aula zaruri nahi.

Is ka jawab youn diya gaya hai keh yeh qiyas nass-e-sareeh kay muqabilay mein hai, Lihaza is ka aitebaar faasid hai.(13)

 

( Allamah Ainiy ( رحمه الله )

Unhon nay bhi is qiyas ko faasid qaraar diya hai.(14)

 

Khulasa-e-kalaam yeh hai keh bartan ko 7 martabah dhona hi wajib hai, Jaisa keh ibteda mein hadith bayan kar di gayi hai.
