(13) KIYA MANNI PAAK HAI ?
Is mein fuqaha nay ikhtelaaf kiya hai.
( Imam Shafi’e, Imam Ahmad( رحمهما الله ):
Manni paak hai.
Un kay dalaail hasb-e-zail hain:
(1) Sayyidah Ayesha ( رضي الله عنها ) say marwi hai keh
Main Rasoolullah ﷺ kay kapday say manni ko khurach diya karti thi, Phir ap ﷺ ussi kapday mein namaz ada farma letay thay.(1)
(2) Sayyidah Ayesha ( رضي الله عنها ) say marwi hai keh
Main Rasoolullah ﷺ kay kapday say manni ko dhoya karti thi, Phir ap ﷺ namaz kay liye nikaltay lekin paani say dhonay kay nishanaat ap ﷺ kay kapday mein maujood hotay.(2)
(3) Daaro Qutani ki riwayaat mein hai keh
Jab manni khushak hoti to main usay ap ﷺ kay kapday say khurach leti thi, Aur jab tar hoti to usay dho deti thi.(3)
In ahadith ka jawab yeh diya gaya hai keh
Yeh Sayyidah Ayesha ( رضي الله عنها ) ka zaati amal tha, Rasoolullah ﷺ ko is ki ittelaa nahi hoti thi,
Lekin yeh baat dorust nahi, Kiyonkeh Rasoolullah ﷺ ussi kapday mein namaz padhi letay thay ( Halankeh khurachnay say sahih safayi nahi hoti ),
Aur agar manni najas hoti to Allah ta’ala ba’zariyah-e-wahi ittelaa day detay, Jaisa keh jutiyon ki gandagi kay muta’allaq ittelaa di thi.(4)
Aur mazeed yeh keh aik riwayaat mein ap ﷺ ka amal bhi maujood hai, Jaisa keh us mein hai:
” يحته من ثوبه يابسا ثم يصلي فيه “
” Nabi ﷺ khushak manni ko apnay kapday say khurach detay, Phir ussi mein namaz padh letay thay.(5)
(4) Sayyiduna Ibn-e-Abbas ( رضي الله عنه ) say marwi hai keh ” إنما هو بمنزلة المخاط والبصاق ” keh manni naak ki rutubat aur thook ki manind hai ” Aur tumhain siraf itna hi kaafi hai keh usay kisi kapday ya izkhar ghaas say saaf kar lo .(6)
(5) Insaan jisay Allah ta’ala nay ashraf-ul-makhluqaat bana kar izzat bakhshi hai us ki takhleeq ka inhisaar issi par hai, Aur yeh kesay mumkin hai keh us ki Asal ho najaasat ho.
(6) Nabi ﷺ ka usay dhonay mein jaldi na karna, Aur usay khushak honay tak chhauday rakhna is ki tahaarat ki daleel hai, Kiyonkeh najaasaton mein ap ﷺ ka tariqah yeh tha keh ap ﷺ fauran dhonay ka hukam detay thay, Jaisa keh dehaati kay pishaab par paani ka daul bahany ka hukam diya.(7)
( Imam Abu Hanifah, Imam Malik ( رحمهما الله ):
Mani najas hai,
( Lekin Imam Abu Hanifah ( رحمه الله ) kay nazdeek Mani agar khushak ho aur usay khurach liya jaye to kapda ba’ghair dhonay kay paak ho jaye ga ).
In kay dalaail hasb-e-zail hain:
(1) Woh tamam ahadith jin mein Mani ko dhonay ka hukam hai.(8)
Yeh najas hai issi liye isay dhonay ka hukam diya gaya hai.
Is ka jawab youn diya jata hai keh siraf dhonay kay amal say kisi cheez ka najas hona saabit nahi hota, Kiyonkeh jin ashiya ki tahaarat par ittefaaq hai masalan: Khushboo, Matti waghairah, unhain bhi dhona sub kay nazdeek jaaiz hai,
Lihazah jisay bura mahsoos kiya jata hai usay bil’aakhir dhonay mein kiya qabaahat hai ? (9)
(2) Sayyiduna Ammaar ( رضي الله عنه ) say marwi hai keh ” Hum Pa’khana, Pishaab, Mazi, Mani aur Qaye lag janay day kapda dhoya kartay thay” (10).
Is ka jawab yeh diya gaya hai keh yeh riwayat za’eef honay ki bina par qabil-e-hujjat nahi hai,
Jaisa keh Imam Daaro Qutani, Imam Uqaili, Imam Bazzar, Imam Ibn-e-Adi aur Imam Abu No’aim waghairah ( رحمهم الله ) sub nay isay za’eef qaraar diya hai.(11)
(3) Choonkeh yeh pishaab ki jaga say kharij hoti hai lihazah is par ussi ka hukam lagaya jaye ga.
Lekin yeh baat bila daleel hai.
(4) Badan kay ganday fuzlaat masalan: Pishaab aur Pa’khana par qiyas kartay huway isay bhi najas kaha jaye ga Kiyonkeh yeh bhi unhi ki tarah ghiza say tayar hoti hai.(12)

Mani najas-o-paleed hai.(13)
( RAAJIH )
Imam Shafi’e aur Imam Ahmad ( رحمهما الله ) ka mo’aqqaf raajih maloom hota hai, Wallah Aalam.
( Imam Ibn-e-Taimiyah ( رحمه الله )
Mani paak hai.(14)
( Ameer San’aani ( رحمه الله )
Haq baat yeh hai keh Asal tahaarat hai, Aur najas kahnay walon par daleel paish karna laazim hai, Aur hum Asal par hi baqi rahnay walay hain.(15)
( Wahabah Zuhaili ( رحمه الله )
Mani ki tahaarat ka qaul ziyadah raajih hai.(16)
( Imam Is’haque, Imam Daud ( رحمهما الله )
Mani taahir hai najas nahi hai.(17)
( Imam Ibn-e-Hazam ( رحمه الله )
Mani paak hai, Khawah pani mein ho, Ya jisam par ya kapday par.(18)
( Sob’hi Hasan Tallaq ( رحمه الله )
Ziyadah raajih yeh hi hai keh Mani paak hain.(19)
[[[[ وَالۡأَصۡلُ: اَلطَّهَارَةُ فَلَا يَنۡقُلُ عَنۡهَا إِلَا نَاقِلٌ صَحِيۡحٌ لَمۡ يُعَارِضۡهُ مَا يُسَاوِيۡهِ أَوۡ يُقَدَّمۡ عَلَيۡهِ ]]]]
[( Har cheez mein ) Asal tahaarat hai, Aur is wasaf say usay koi cheez kharij nahi karti magar siraf aisi daleel jo us kay masaawi ho ya us say ziyadah sahih ho.{1}]
{1} Sayyiduna Salman Farisi ( رضي الله عنه ) say marwi hai keh Rasoolullah ﷺ nay farmaya:
” ألحلال ما أحل الله في كتابه والحرام ما حرم الله في كتابه وما سكت عنه فهو مما عفا عنه “
” Halal woh hai jisay Allah ta’ala nay apni kitab mein halal qaraar diya hai,
Haram woh hai jisay Allah ta’ala nay apni kitab mein haram qaraar diya hai,
Aur jis say khamaushi ikhtiyaar ki hai woh aisi ashiya say hai jinhain us nay mu’aaf kar diya hai “(20)
Allah ta’ala nay jin ashiya par hukam laganay say sukoot ikhtiyaar farmaya hai un par ussi tarah khamaushi ikhtiyaar karna hi zaruri hai,
Aur kisi kay liye yeh jaaiz nahi keh jis cheez ki najaasat kay muta’allaq koi waazih daleel maujood na ho mahaz apni faasid raaye aur ghalat istedlaal say us par najaasat ka hukam laga day,
Jaisa keh baaz ahl-e-ilam nay yeh gumaan kartay huway keh ” tahreem aur najaasat lazim-o-malzoom hain ” un ashiya ki najaasat ka dawa kiya hai jinhain Allah ta’ala nay haram qaraar diya hai,
Halankeh yeh gumaan intehayi baatil-o-be’buniyaad hai,
Kisi cheez ki hurmat dalaalat ki kisi bhi qisam ( mutabiqui, tazammuni, iltezami ) say us kay najas honay par suboot faraham nahi krti.
Masalan: sharaab, murdaar aur khoon ka haram hona un kay najas honay ka suboot nahi hai.
Ghaliban yeh hi wajah hai keh Rasoolullah ﷺ nay is ishkaal ko rafa karnay kay liye farma diya tha:
” إنما حرم الميتة “
” Murdaar say siraf us ka khana hi haram qaraar diya gaya hai “(21)
Agar bil’farz yeh qaaidah musallam hota keh har haram cheez najas bhi hai, To yeh aayat ” حرمت عليكم امهاتكم ” maaun kay najas honay ka suboot hoti, Halankeh us ka koi bhi dawaidar nahi.
