TAHAARAT HASIL KARNAY KA ASAL ZARIYAH PAANI HAI, KOI CHEEZ US KAY QAAIM MAQAM NAHI HO SAKTI MAGAR YEH KEH SHAARI’E NAY KISI CHEEZ KA HUKAM DIYA HO

 


[[[[ وَالۡمَاءُ هُوَالۡأَصۡلُ فِي التَّطۡهِيۡرِ فَلَا يَقُوۡمُ غَيۡرُهُ مَقَامَهُ إِلَّا بِإِذۡنٍ مِنَ الشَّارِعِ ]]]]


( Tahaarat hasil karnay ka asal zariyah paani hai, koi cheez us kay qaaim maqam nahi ho sakti magar yeh keh Shaari’e nay kisi cheez ka hukam diya ho {1})

 

{1} Jaisa keh kitab-o-sunnat mein paani kay sath hi is wasaf ko mukhtas kiya gaya hai.

 

(1) Irshad-e-baari ta’ala hai keh:

” و أنزلنا من السماء ماء طهورا ”

Al-furqan_Aayat no: 48.

 

(2) Hadith-e-nabawi hai keh:

” الماء طهور لاينجسه شيء “

” Paani paak hai, Koi cheez usay napaak nahi karti “(1)

 

( Jam’hoor, Ahmad, Malik, Shafi’e ( رحمهم الله )

Najaasaton say tahaarat hasil karnay kay liye siraf paani ko iste’imaal kiya jaye ga,

Imam Muhammad, Imam Zofar, aur Imam Is’haque Ibn-e-Rahway ( رحمهم الله ) ka bhi yeh hi mo’aqqaf hai.

Unhon nay Hadith-e-Asma bint-e-abi bakar ( رضي الله عنها ) ( keh jis mein kapday say hiaz ka khoon dhonay ka zikar hai ) aur Hadith-e-Ali ( رضي الله عنه ) ( jis mein mazi dhonay ka zikar hai ) say istedlaal kiya hai.

 

( Abu Hanifah aur Abu Yousuf ( رحمهما الله )

Siraf paani say nahi Balakeh har paak mayi cheez kay zariyeh najaasaton say tahaarat hasil karna jaaiz hai.

Inhon nay un tamam ahadith say istedlaal kiya hai jin mein paani kay ilawah deegar ashiya say tahaarat hasil karnay ka zikar hai, Masalan:

Hadith-e-Ayesha ( رضي الله عنها ) ( jis mein Haiz kay khoon ko kapday say khurachnay ka hukam hai ),

Aur issi tarah jin ahadith mein har chamday ko rangnay aur jooti ko ragadnay kay sath paak karnay ka zikar hai.(2)

 

( RAAJIH )

Haq baat yeh hai keh ashiya ko paak karnay kay liye asal paani hai, Kiyonkeh kitab-o-sunnat mein ussi ko is wasaf kay sath muttasif kiya gaya hai, Taaham har najaasat ko paak karnay kay liye siraf ussi ko muta’ayyan kar lena is liye dorust nahi nahi ( Kiyonkeh woh ahadith jin mein Mani aur haiz kay khoon ko khurachnay aur jooti ko ragadnay aur paani kay ilawah deegar tariqon ka zikar hai ) iska rad karti hain.

Aur agar har paak mayi cheez kay zariyeh tat’heer ki ijazat di jaye to Shaari’e nay iska kahin zikar nahi kiya ( is wajah say bhi yeh dorust nahi )

Lihaza ” خير الأمور اوسطها ” kay tahat mutawassit-o-moutadil raah yeh hi hai keh  shari’at mein jin ashiya ko paani kay ilawah kisi aur tariqay say paak karna manqool hai Unhain ussi tariqay say paak kiya jaye, ( Masalan: jooti ko zameen par ragadna waghairah )

Aur jin ashiya ko paak karnay ka hukam to maujood hai Lekin Shaari’e ﷺ nay unki tat’heer ka koi tariqah-o-kaifiyat nahi batlayi to unhain paani kay sath hi paak kiya jaye, Kiyonkeh tat’heer mein asal yeh hi hai.(3)
