AUR US PAR 3 PATHARON ( DHILON {1}) YA UN KAY QAAIM MAQAM {2} KISI PAAK CHEEZ SAY ISTINJAA KARNA LAZIM HAI

[[[[ وَعَلَيۡهِ الإِسۡتِجۡمَارُ بِثَلَاثَةِ أَحۡجَارٍ طَاهِرَةٍ أَوۡ مَا يَقُوۡمُ مَقَامَهَا ]]]]


( Aur us par 3 patharon ( dhilon {1}) ya un kay qaaim maqam {2} Kisi paak cheez say istinjaa karna lazim hai )

{1}= Is kay dalaail hasb-e-zail hain:

(1) Sayyiduna Salman Al-farisi ( رضي الله عنه ) say marwi hai keh :

” نهانا أن نستنجي بأقل من ثلاثة أحجار”

” Ap ﷺ nay hamain 3 patharon say kam kay sath istinjaa karnay say nama farmaya hai.(1)

(2) Sayyiduna Abu Hurairah ( رضي الله عنه ) say marwi hai keh:

أن النبي ﷺ كان يأمر بثلاثة أحجار “

” Nabi ﷺ s 3 patharon say istinjaa karnay ka hukam detay thay.(2)

(3) Sayyidah Ayesha ( رضي الله عنها ) say bhi issi ma’ana mein hadith marwi hai.(3)

(4) Nabi ﷺ nay qaza-e-haajat kay liye jatay waqat Sayyiduna Ibn-e-Masood ( رضي الله عنه ) ko 3 pathar lanay ka hukam diya.(4)

In ahadith say maloom huwa keh istinjaa karna wajib hai, Aur 3 patharon ya 3 martabah ragadnay kay sath ( khawah aik hi pathar ho jis kay 3 mukhtalif atraaf hon ) wajib hai.

3 patharon say kam iste’imaal karna jaaiz nahi ( Agarcheh kam kay sath hi tahaarat-o-safayi hasil ho jaye  ), Albattah hasb-e-zarurat 3 patharon say zaaid iste’imaal karnay hoi haraj nahi.

Issi kay qaail hain.

( Imam Malik, Imam Abu Daud ( رحمهما الله )

Wajib siraf safayi karna hai khawah aik pathar say hi ho jaye .

( Imam Abu Hanifah( رحمه الله )

Istinjaa karna wajib nahi Balakeh sunnat hai, Aur is say murad siraf safayi karna hai  khawah kitnay hi patharon say hasil ho.(5)

Jinhon nay 3 patharon kay iste’imaal ko wajib nahi kaha un kay dalaail hasb-e-zail hain:

(1) Sayyiduna Abu Hurairah ( رضي الله عنه ) say marwi hai keh Nabi ﷺ nay farmaya:

” من إستجمر فليوتر من فعل فقد أحسن ومن لا فلا حرج “

” Jo shakhs pathar iste’imaal karay to witar ( taaq ) karay, Jis nay aisa kiya bai’shak us nay acha kiya, Aur jis nay aisa nahi kiya to us mein koi haraj nahi.(6)

(2) Sayyiduna Ibn-e-Masood ( رضي الله عنه ) 2 pathar aur aik gaubar ka khushak tukda lekar aaye to ap ﷺ nay donon pathar lay liye aur gaubar ka tukda phaink diya.(7)

Is hadith say istedlaal kartay huway Imam Tahawi ( رحمه الله ) nay kaha hai keh ” Agar 3 pathar zaruri hotay to Rasoolullah ﷺ Sayyiduna Ibn-e-Masood ( رضي الله عنه ) ko teesra pathar talash karnay ka hukam detay, Jabkeh ap ﷺ nay aisa nahi kiya.

Is ka kayi tarah say jawab diya gaya hai:

(1) Musnad-e-Ahmad ki aik riwaayat mein hai keh ap ﷺ nay Sayyiduna Ibn-e-Masood  ( رضي الله عنه ) say farmaya:

” إئتني بحجر ثالث “

” Meray pas koi teesra pathar lay aao ” (8)

Is riwaayat par munqati’e honay ka aiteraaz kiya gaya hai, Lekin Hafiz Ibn-e-Hajar ( رحمه الله ) nay kaha hai keh menay isay mausool paya hai.(9)

(2) Agar hum is riwaayat ka za’eef hona aur teesray pathar ka adm-e-zikar tasleem kar bhi len tab bhi yeh un ki daleel nahi banti, Kiyonkeh is mein mujarrad ihtemaal hai aur hadith-e-Salman mein nass hai keh 3 patharon say kam iste’imaal na kiye jayen ,

Lihazah nass kay muqabilay mein ihtemaal qabil-e-hujjat nahi.(10)

(3) Qaul aur fail kay ba’ham ta’aaruz kay waqat qaul ko tarjeeh hoti hai.(11)

(4) ( RAAJIH )

Imam Shafi’e aur Imam Ahmad ( رحمهما الله  ) ka mo’aqqaf raajih hai.(12)

Imam Nawawi ( رحمه الله ) raqam-e-taraz hain keh qubul aur dubur kay istanjay mein 6 martabah malna yaani har aik ko 3, 3 martabah malna zaruri hai aur afzal yeh hi hai keh 6 pathar hon , Lekin agar aik hi aisa pathar iste’imaal kar kiya jaye jis kay 6 atraaf hon to jaaiz hai.(13)

Imam San’aani ( رحمه الله ) bayan kartay hain keh:

Ahadith mein aisa koi zikar maujood nahi hai, Agar aisa hota to Nabi ﷺ bhi kisi waqat 6 pathar talab farma letay ( Halankeh aisa kuch bhi saabit nahi )(14).

{2}=(1) Sayyiduna Khuzaimah Ibn-e-Saabit ( رضي الله عنه ) say marwi hai keh Rasoolullah ﷺ say istinjaa karnay kay muta’allaq sawal kiya gaya to ap ﷺ nay farmaya:

” بثلاثة أحجار ليس فيها رجيع “

” Aisay 3 patharon kay sath jin mein gaubar na ho “(15)

(2) Sayyiduna Salman Al-farisi ( رضي الله عنه ) say marwi riwaayat mein hai keh  ” gaubar aur haddi say istinjaa na kiya jaye “(16).

In ahadith aur is ma’ana ki deegar ahadith say maloom hota hai keh gaubar, leed ya haddi waghairah say istinjaa karnay say ap ﷺ ka mana farmana is baat ka suboot hai keh pathar ya us ki misil paak ashiya say istinjaa karna dorust hai.(17)

Pathar kay qaaim maqam har aisi cheez say istinjaa karna jaaiz hai Jo jamid, taahir, najaasat ki zaat ko zaail kar denay wali ho aur jis koi hurmat-o-taqdees na ho aur na hi kisi haiwan ka koi juz’o ho.

Masalan: Lakdi, kapday ka tukda, eint aur theekri waghairah. ( In kay dalaail guzishtah ahadith hain ).

Istinjaa siraf patharon kay sath hi jaaiz hai  Jaisa keh hadith mein us ka hukam mazkoor hai,

Imam Ahmad ( رحمه الله ) say bhi aik riwaayat mein yeh hi mazhab manqool hai.(18)
