17. Haadsaati aur Ijtima’ee tor par marnay walay ki Waraasat.

*Meeras-ul-gharqa’a wal-hudma’a wal-harqa’a*

*Haadsaati aur Ijtima’ee taur par marnay waalon ki meeras:*

Gharqa’a aur hadma’a se moraad khooni rishtedaaron ka woh group hai. jo aik hi waqt mein kisi sabab ki wajah se faut ho jaayen. Maslan zalzala mein, chhat se neechay dab kar mar gaye ya kashti mein sawaar thay aur kashti gharq hogayi, ya aag mein jal gaye, ya ta’oon jaisi wabaai marz mein faut ho gaye, ya hawaai jahaaz ke haadsa mein halaak ho gaye, aur yeh nah maloom ho sakay ke un mein se pehlay kon mara hai aur baad mein kon faut huwa hai.


*Gharqa’a aur hadma’a ki meeraas ki taqseem ka tareeqa:*


Gharqa’a aur hadma’a ki meeras ke baare mein fuqaha’a mein ikhtilaaf paaya jata hai. Ahnaaf, Maalkiyah aur shaafiyah ke nazdeek agar yeh maloom nah ho sakay ke un mein pehlay kaun faut hua hai to is soorat mein faut shudgaan aapas mein aik doosray ke waaris nahi honge balkay har aik ki jayedaad un ke zindah warison ke darmiyaan taqseem ki jayegi. Un ki daleel khalifah Rasool Sayyedna Abu Bakar رضی اللہ عنہ ka woh qoul hai ke jab jung-e-Yamaama mein bohat se Sahaaba shaheed ho gaye to aap ne Zaid bin Saabit رضی اللہ عنہ ko hukam diya tha ke sirf shaheedon ke zindah waarison ko un ka waaris banaya jaye is tarah Sayyidna Ameer-ul-momineen Umar bin Al Khattaab رضی اللہ عنہ ke ahad mein bohat se log amwaas mein ta’oon ki waba’a mein faut ho gaye to aap ne bhi Zaid bin Saabit رضی اللہ عنہ ko hukum diya ke faut shudgaan ke zindah waarison ko un ka waaris banaaya jaye.

Imam Ahmed bin Hanbal رحمۃ اللہ علیہ farmaatay hain ke agar yeh saabit ho jaye ke sab log aik hi waqt mein wafaat pa gaye hain aur kisi shak ki koi gunjaa’ish nah ho to un ke zindah waaris hi un ki jayedaad ke waaris honge jaisa ke ai’imah salasa ka mazhab hai.

Lekin agar yeh saabit nah ho sakay ke woh ikatthay faut huye hain aur yeh bhi maloom nah ho sakay ke un mein se kon pehlay faut huwa hai aur kon baad mein mara hai to phir haadsa mein marnay waalay aik doosray ki puraani jayedaad (al-talaad) ke waaris honge. Lekin nayi jayedaad (al-tareef) yani jo tarkah usay doosri mai’yat se mila hai woh is ka waaris nahi hoga. Kyun kay se aik hi shakhs ka dobaarah apne hi maal ka waaris hona laazim aata hai. Ya’ni khud hi Moris aur khud hi waaris yahi raaye tabaeen mein se qaazi Shuraah, Ibraahim al-nakh’ee aur al-sa’abee رحمۃ اللہ علیہم ki bhi hai. Yahi mazhab raajah ma’loom hota hai.

*Misaal:*

Do a’ainyi bhai aik haadsa mein ikatthay wafaat paa gaye. Pehle bhai ne apni biwi, beti aur chacha zindah chorra aur doosray bhai ne apni do betiyan aur mazkoorah chacha ko zindah chorra.

*Hal:*

Ahnaaf, Maalkiyah, aur Shaafiyah ke mazhab ke mutaabiq dono bhai aik doosray ke waaris nahi honge balkay pehlay bhai ki jaedaad us ki biwi, beti aur chacha ke darmiyaan taqseem kar di jayegi. Is ka asal masa’la (8) hai biwi ko (1/8), (1) mila, beti ko (1/2), (4) miley aur baqi (3) chacha batoor-e-asaba lega.

Doosray bhai ka tarka is ki do betiyon aur chacha ke darmiyaan taqseem kya jayega.

*Hal:*

Is ka asal mas’ala (3) hai do betiyon ko (2/3) (2) miley aur baqi (1) chacha bataur-e-asaba lega.

Imam Ahmed bin Hanbal رحمۃ اللہ علیہ ke mazhab ke mutaabiq dono bhaai aik doosray ki puraani jaedaad (al-talaad) ke waaris honge. un ke masaail ka hal manaasikha waalay masaail ki tarhan hi hai.

Pehlay bhaai ke mas’ala ki soorat is tarha hogi. pehla bhai apni biwi beti, chacha aur bhai ko zindah chhor kar faut ho gaya. phir jaedaad ki taqseem se qabal doosra bhaai apni do baitiyon aur mazkoorah chacha ko zindah chhor kar faut ho gaya.

Doosray bhai ka masla is tarha hoga, doosra bhai faut ho gaya is ne apni do betiyan, chacha aur bhai ko zindah chorra. phir jaedaad ki taqseem se qabal bhai apni biwi, beti aur mazkoorah chacha ko zindah chhor kar faut ho gaya.


*Pehlay bhaai ke mas’ala ka hal*

*Haal* Is ka jamea (8) hai biwi ko (1) mila.

Beti ko (4) miley chacha ko (1) mila aur doosray bhaai ki baitiyon ko (2) miley.


*Doosray bhaai ke mas’ala ka hal*


 

*Hal* Is ki jamea (24) hai us ki betiyon ko (16) miley. chacha ko (3)

miley. Doosray bhaai ko biwi ko (1) mila aur is ki beti ko (4) miley.
