CHATA HUKUM: JIMA’
Khawind par haram hai keh wo apni biwi se jima’ kare aur aurat par bhi haram hai keh wo is baare mein apne khawind ko qudrat ka mouqa den kyunkeh Allah Ta’aala ka farmaan hai:
وَ یَسۡئَلُوۡنَکَ عَنِ الۡمَحِیۡضِ ؕ قُلۡ ہُوَ اَذًی ۙ فَاعۡتَزِلُوا النِّسَآءَ فِی الۡمَحِیۡضِ ۙ وَ لَا تَقۡرَبُوۡہُنَّ حَتّٰی یَطۡہُرۡنَ ۚ
“Wo Apse haiz ke baare mein suwal karte hain kehedo keh wo gandagi hai, Halat-e-haiz mein aurton se alag raho jab tak wo paak na hojaey.”
“Maheez” se haiz ka zamana aur haiz ki jagah(sharmgaah) murad hai.
Aur isi tarha Aap(ﷺ) ka farmaan hai:
“ اصْنَعُوا كُلَّ شَىْءٍ إِلاَّ النِّكَاحَ یعنی الجماع“
“Yani jima ke alawah har cheez aurat se karsakte ho.”
[Sahih Muslim: 302]
“Aur isi tarha musalmaanou ka ijmaa hai keh haiza ki sharmgaah mein Wati karna haram hai.”
[Shaykh Uthaymeen(رحمه الله) ne jo musalmaanou ka ijmaa’ zikr kiya hai us baare mein Hafiz ibn kaseer ne tafseer ibn kaseer (1/531) mein farmaaya hai: “اجمع العلماء على تحريمه وهو المباشرة في الفرج “]
Ulema ne “Farj” mein mubashirat ki tahreem par ijmaa kiya hai.”
Jo admi Allah Ta’aala aur youm-e-Akhirat par imaan rakhta hai uske liye halal nahi hai keh wo is munkar kaam ki tarf paish qadmi kare jisko mumaniyat par Allah Ta’aala ki kitaab, Rasool Allah(ﷺ) ki sunnat aur musalmaanon ka ijmaa dalalat karta hai, agar koi is fail ka murtakib hoga wo aise logon mein shumar hoga keh jinho ne Allah Ta’aala aur uske Rasool(ﷺ) aur mominon ke ijma ki mukhalifat ki.
Imaam Nawawi(رحمه الله) ne Sharh al mahzab mein likha hai keh Imaam Shafa’i(رحمه الله) ne farmaaya hai jisne haiz ki halat mein biwi se jima’ kiya wo kabeerah gunaah ka murtakib hua.”
Hamaare as’hab wagherahum ne kaha hai:
“Jisne Haiza se wati karna halal qarar diya uske kafir hone ka hukum lagaya jaega.”

Jima’ ke alawah mard keliye aise umoor mubah kiye gae hain jo iski shahuwat ko poora karsake misaal ki taur par bosa wo kinar karna, baghalgeer hona aur sharmgaah ke alawah jism se jism milana wagherah lekin bahetar ye hai keh mubashirat karte waqt naaf se lekar ghutne tak uppar kapra rakhlen kyunkeh Sayeda Ayesha(رضی اللہ عنہا) ki hadees hai “Aap(ﷺ) mere sath ikhatte hote aur main halat-e-haiz mein hoti thi.”

Haiz ki halat mein aurat se mujami’at karna haram hai aur tibbi lehaz se bhi muzar hai aur moujab amraaz hai aur is halat mein jo majuma’at karta hai usse kaffarah ada karna chaheye jaise keh “Abdullah bin Abbas(رضي الله عنه) ki hadees hai keh Aap(ﷺ) ne farmaaya jo admi ba halat-e-haiz apni aurat se jima’ kare tou usse chaheye keh aik dinar ya nisf dinar sadqa kare” [Abu Dawood: 264; Sunan Nasai: (1/53); Tirmidhi: 136; Ibn majah: 640; Daarmi: (1/254); Musnad ahmad: (1/230) ; Hakim(1/171); Baihaaqi: (1/313); Is hadees ko Hakim, Zahabi aur Ibn Qayyim ne “Tahzeeb al sunan (1/173) mein Ibn Tar kaamani ne “Al jawhar al naqi (1/314) mein, Shaykh Ahmad Shakir ne “Tahqeeq at tirmidhi” mein, Shaykh Albani ne “Irwa ul ghaleel(197) aur Adab uz zafaaf (45) mein Sahih kiya hai aur isko Imaam ahmed bin hanbal, Ibn al qataan, Ibn daqeeq al eid aur Hafiz ibn hajar ne bhi sahih kaha hai. Mulaheza ho “Talqees al jair “ (1/165-166) Allamah Shawkani “Neel Awtaaf(1/343) mein farmaate hain. “Ye Hadees us shakhs par kaffare ke wujoob par dalalat karti hai jo Halat-e-haiz mein apni biwi se jima’ karta hai aur Is taraf Ibn Abbas(رضي الله عنه) Hasan basri(رحمه الله), Sayed bin jubyr, Qatadah, Awzai. Ishaaq, Ahmad bin hanbal, Shafa’i(Apne qadeem ke mutabiq) gae hain- aur isi qawl ko Allamah Shawkaani ne qavi qarar diya hai. |
