21. PAAK DAMAAN AURTON PAR ZINA KI TOHMAT LAGAANA [ Accusing A Woman of Adultery]

 Paak Daaman aurton par Zina ki tohmat lagane ki mumani’at:

Allah ta’ala ne farmaya:

 

إِنَّ ٱلَّذِينَ يَرْمُونَ ٱلْمُحْصَنَٰتِ ٱلْغَٰفِلَٰتِ ٱلْمُؤْمِنَٰتِ لُعِنُوا۟ فِى ٱلدُّنْيَا وَٱلْءَاخِرَةِ وَلَهُمْ عَذَابٌ عَظِيمٌ ۞يَوْمَ تَشْهَدُ عَلَيْهِمْ أَلْسِنَتُهُمْ وَأَيْدِيهِمْ وَأَرْجُلُهُم بِمَا كَانُوا۟ يَعْمَلُونَ۞

 

“Woh log jo Paak Daaman, bholi bhali, ima daar aurton par Zina ki tohmat lagate hain, un par Dunia wa akhirat donon mein la’anat hogi, aur unhen bara azab hoga, jis din un ki zabanen, un kay hath aur un kay paun un kay khilaf un kay aa’mal ki gawahi denge”

An-Nur 24 : 23-24

 

Aur Allah ta’ala ne farmaya:

 

وَٱلَّذِينَ يَرْمُونَ ٱلْمُحْصَنَٰتِ ثُمَّ لَمْ يَأْتُوا۟ بِأَرْبَعَةِ شُهَدَآءَ فَٱجْلِدُوهُمْ ثَمَٰنِينَ جَلْدَةً وَلَا تَقْبَلُوا۟ لَهُمْ شَهَٰدَةً أَبَدًا ۚ وَأُو۟لَٰٓئِكَ هُمُ ٱلْفَٰسِقُونَ۞

 

“Aur woh log jo Paak Daaman aurton par tohmat lagate hain, phir chaar gawah paish na kar saken to unko 80, 80 kaure lagao aur (us kay ba’ad kabhi unki shahadat qubool na karo, aur yeh log faasiqo badkaar hain”

An-Nur 24 : 4

Allah ta’ala ne aayat mein bayan farmaya hai keh jo shakhs kisi Paak Daaman, aazad iffat daar aurat par Zina aur fahishah hone ka bohtan lagae tou woh Dunia wa akhirat mein mal’oon hai aur us kay lie bara azab hai aur Dunia mein us par 80 kauron ki hadd hai, aur agarcheh woh aadil ho, uski gawahi qubool nahin ki jaegi

 

RasullAllah ﷺ ne farmaya:

 

“7 mohlikat se bacho”

 

Aur Aap ne un par Paak Daaman, bholi bhali momin aurton par tohmat lagane ko bhi shumar kia, aur “qazaf” yeh hai keh koi shakhs kisi ajnabi, Azad, Paak Daaman musalman Khatoon se kahe: ae zaniah! Ya ae baghiyah! Ya ae badkaarah! Ya woh us kay khawand se kahe: badkaarah kay khawand! Ya us kay bache se kahe: zaniah kay bache! Ya badkaarah kay bete! Ya uski beti se kahe: zaniah ki beti! Ya badkaarah ki beti! Kyun keh “qahbah” zaniah se ibarat hai, pas jab koi aadmi ya koi aurat kisi mard ya kisi aurat se kahe: jis tarah us ne kisi aadmi se kaha: ae zaani! Ya woh kisi Azad bache se kahe : ya alaq! Ya ae mankooh! Tou aise shakhs par 80 kauron ki hadd wajib ho jaegi, illa yeh keh woh us par “bayyinah” paish kar sake aur “bayyinah” jesa keh Allah ta’ala ne farmaya: 4 gawah Jo us kay, us aurat ya mard par bohtan lagane kay baare mein tasdeeq karen, pas agar woh daleel paish na kar sake tou phir us aurat, jis par us ne tohmat lagai hai ya us aadmi, jis par us ne tohmat lagai hai kay mutalibe par, us (tohmat lagane wale) shakhs par 80 kaure lagae jaenge aur isi tarah jab us ne apne mamlook ya apni laundi par tohmat lagai keh use kaha: ae zaani: ya apni laundi se kaha: ae zaniah! Ya ae baghiyah! Ya ae badkaarah! (Tou bhi us par hadd lagai jaegi) jesa keh RasullAllah ﷺ ne farmaya:

“Jo shakhs apne mamlook par Zina ki tohmat lagate aur agar woh wesa na ho jesa keh us ne kaha hai, tou Roz-e-Qayamat us par hadd qaim ki jaegi” [Bukhari: 6858; Muslim:  1660]

Bohot se jahil log is qisam kay fohosh kaam mein mubtala hain jo Dunia wa akhirat mein un kay lie uqoobat ka baa’is hai, isi lie RasullAllah ﷺ se sabit hai keh aap ne farmaya:

“Beshak aadmi koi aisa kalimah Bolta hai, jis kay anjam se woh waqif nahin hota, lekin woh uski wajah se Jahannum mein is qadar door ja girega jitna mashriq aur maghreb mein bo’ud hai” [Bukhari; Muslim]

Maaz bin jabal رضي الله عنه ne aap se arz kia, Allah kay Rasul! Ham Jo bat cheet karte hain, us par hamara mu’khizah hoga? Tou aap ne farmaya: “Maaz teri maan tujhe gum paae, bhala logon ko chehron kay bal Jahannum mein kon si baten dalengi? Yahi zaban se nikli hui baten”

Aur hadith mein hai: “Jo shakhs Allah aur yaume akhirat par Iman rakhta ho use chahie keh woh Khairo bhalai ki bat kare ya woh khamosh rahe” [Bukhari; Muslim]

Allah tabarak wa ta’ala ne apni kitabe Aziz mein farmaya:

مَّا يَلْفِظُ مِن قَوْلٍ إِلَّا لَدَيْهِ رَقِيبٌ عَتِيدٌ۞

 

Woh koi lafz bhi munh se nahin nikalne paate magar muhafiz (farishta use zabte tehreer mein laane kay lie) us kay pas tayar renta hai”

Qaf 50 : 18

 

Uqbah bin Amir رضي الله عنه ne arz kia: Allah kay Rasul! Nijat kia hai? Aap ne farmaya:

“Apni zaban par qabu rakh, tera Ghar tere lie kafi hona chahie aur apni khataon par roya kar, kyun keh sakht Dil shakhs tamam logon se ziadah Allah se dur hota hai” Abu Dawood; Tirmidhi]

Aur aap ﷺ ne farmaya:

“Allah kay haan, fohosh go aur bad Kalam shakhs tamam logon se ziadah mabghooz wa napasand hai”

Allah ta’ala apne ehsano Karam se hamen aur tumhen hamari zabanon kay Shar se mehfuz rakhe, kyun keh woh sakhi daata fayyaz hai [3]

[3] Mu’allif ne “as sughra” mein farmaya: Jo shakhs Ummul Momineen Ayesha رضي الله عنها par unki aasman se bara’at nazil hone kay ba’ad bhi tou woh Quran ko jhutlane wala kafir hai, aur use halate kufur mein qatal kar dia jaega

 Accusing A Woman of Adultery

Allah Most High says,

{Those who slander chaste secured, and believing women are cursed in this life and in the hereafter: for them is a grievous chastisement. On the day when their tongues, their hands, and their feet will bear witness against them as to their as to their actions.}

(24: 23-24)

He also says, {And those who launch a charge against chaste women and produce not four witnesses (to support their allegations) -flog them with eighty stripes: and reject their evidence ever after: for such men are wicked transgressors.}

(24: 04)

Allah the Almighty in these verses makes it clear that whosoever unjustly accuses as chaste free woman of committing adultery is cursed both in this world and in the hereafter, and deserves grave chastisement.

In addition, he is flogged with eighty lashes and his witness is not accepted even though he is just.

In the Sahih Bukhari and Muslim -the Prophet says,

“Avoid seven heinous sins…..”

And among which he mentioned charging believing women, unmindful though innocent, with adultery”

An example of such an accusation is if someone says to a Muslim chaste free woman:” You are an adulteress.” or “a harlot”, or “a whore” or to say to her husband, “you are the prostitute’s husband” or to call her child as ” the whore’s child”

The same rule is applied if someone slanders a man of committing adultery, or a free boy with pederasty. The unjust accuser in all the above cases must suffer eighty stripes unless he brings a testimony of four men who support his allegation. Otherwise, he must be flogged with eighty lashes upon the request of the offended person.

The Prophet, too, forbade a man to wrongfully accuse his bondman or his slave girl of committing adultery.

A person who accuses his maid servant with adultery, will be subjected to the punishment of slandering on the Day of Judgement unless he happens to be true”

A lot of ignorant people are indulged in such offenses which procure the chastisement in this world and in the hereafter.

When a person says something unknowingly right or wrong, it may lead him to fall down in hell as far away as the distance between the east and west.

Mu’az b. Jabal asked, “0 Messenger of Allah! Will we be called to account for what we say?” The Prophet answered “May you be lost to your mother! The people will be thrown with their face.” down, into the hell only on account of the product of the tongues “i.e. their talking: ” He who believes in Allah and the Day of Resurrection should speak well. Otherwise, he should keep silent.”¹

Allah says,

{Not a word does he utter but there is a vigilant Guardian.}

(50:18)

‘Uqbah Ibn ‘ Amir once asked the Prophet (pbuh),

“What is the salvation, Allah’s Apostle?” The Prophet said, “Control your tongue, keep inside your house,and weep (be sorry) for your sins. And the person farthest from Allah will be the one whose heart is hard”²

“Verily Allah dislikes the indecent obscene person “³
