06. Hajab ki behas.

Baab -ul- hajab (Hajab ki behas )*

*Hajab key lughwi maienay*

 

Hajab rokney aur mana karne key ma’ienay mein aata hai,

Quran kareem mein hai

كلا إنهمْ عنْ ربهمْ یومئذٍ لمحْجوبون )

 

Hijaab (parda) aur Hajab ( darbaan ) is key maakhoz hain .

 

*Istilahi ma’ienay*

 

Meeras mein hajab se muraad kisi waaris ko dosray waaris ki mojoodgi ki wajah sey kulia mahroom karna hai ya kisi waaris key baray hissay mein kami karna hai maslan betay ki mojoodgi mein bhaai kulia mahroom ho jata hai is terhan aulaad ki mojoodgi mein maa aik tahai (1/3 ) ki bajaaye chhata hissa ( 1/6 ) laiti hai .

Hajab ki do qismain hain.

Hajab -e- Harmaan

Hajab -e- nuqsaan

 

*Hajab -e- Harmaan ki tareef*

 

Kisi waaris ko dosray waaris ki mojoodgi ki wajah se jaedaad se kulia mahroom karne ko mojab -e- Harmaan kehte hain .maslan betay ki mojoodgi mein pota waraasat se mahroom ho jata hai.

Hajab -e- Harmaan ka itlaaq baap, maa, khaawand, biwi, beta, beti. yani un chay afraad key ilaawa baqi sab waarison par hota hai.

 

*Hajab -e- Harmaan ki bunyaad do qaidon par hai*

 

Jis waaris ka t’alluq maiyat ke sath kisi waastay se ho to is waastay ki mojoodgi mein woh shakhs waraasat se mahroom hoga. maslan potay ka maiyat se t’alluq is key betay ke waastey se hai is liye pota betay ki mojoodgi mein waaris nahi hota. isi terhan maiyat ke sath naani ka t’alluq maa ke waastay se hai lehaza maa ki mojoodgi mein naani mahroom hoti hai. jo waaris rishta mein maiyat se ziyada qareeb hoga woh waaris hoga jo ba’eed ho ga woh waaris nahi hoga

*الاقرب فالأقرب*

jaisa (العصبة بالنفس) ki tarbiyat mein zikar ho chuka he. yani bhaai ki nisbat beta maiyat sey ziyaada qareeb hai is liye beta waaris ho ga is ki mojoodgi mein bhaai waaris nahi hoga .

 

*Hajab -e- nuqsaan ki tareef*

 

kisi waaris ko dosray waaris ki mojoodgi ki wajah se usay is key badhy hissa se mahroom kar ke chota hissa ka haqdaar bananay ko hajab -e- nuqsaan kehte hain . maslan khaawand ko maiyat ki aulaad ki mojoodgi mein nisaf hissa (1/2) ki bajaaye choutha hissa (1 / 4) milta hai .

 

*Hajab -e- nuqsaan se mutaasira afraad*

 

Hajab -e- nuqsaan se khaawand, biwi, maa, poti aur ‘allati behan yani sirf paanch afraad mutaasir hotay hain. khaawand maiyat ki aulaad ki mojoodgi mein (1/2 ) hissa se mahroom ho kar (1 /4) ka waaris banta hai. biwi maiyat ki aulaad ki mojoodgi mein (1/4) hissa se mahroom ho kar (1 /8) ki waaris hoti hai. maa aulaad ki mojoodgi mein ya maiyat key do bhaaiyon ya do behnon ki mojoodgi mein (1/3 ) se mahroom ho kar (1/6) ki waaris banti hai .

 

Poti maiyat ki aik beti ki mojoodgi mein apne badhy hissa (1 /2) se mahroom ho kar ( 1 /6 ) ki waaris banti hai. ‘allati behan aik ‘Aini behan ki mojoodgi mein apne badhy hissay ( 1 /2) se mahroom ho kar ( 1 /6 ) ki waaris banti hai. beti, betay ki mojoodgi mein apne badhy hissay ( 1/2 ) se mahroom hor kar, asbah bil ghair ban kar kam laiti hai .

 

*Note*

Jo shakhs meeraas key Maney ki wajah se waraasat ka ahal nahi hota maslan kafir ya maiyat ka qaatil yeh kisi dosray waaris key liye mojab -e- Harmaan ya mojab -e- nuqsaan ka sabab nahi hoga. khuda na khwaasta agar beta kafir hai to is ki mojoodgi mein khaawand apna bada hissa ( 1 /2 ) le ga. isi terhan is ki mojoodgi mein pota ya bhaai waraasat se mahroom nahi hunge. agar koi waaris kisi dosray waaris ki mojoodgi ki wajah se Mehjoob hai to woh dosray waarison key liye hajab nuqsaan ka sabab ban sakta hai maslan maiyat key do ya do se ziyaada bhaai maiyat key baap ki mojoodgi mein waaris nahi bantay lekin un ki mojoodgi maa ka hissa kam kar deti hai yani woh ( 1 /3 ) ki bajaaye ( 1 / 6 ) ki haqdaar hogi .
