15. Hijrhey ki Waraasat.

*Meeraas-ul-Khunsa

( Mukhannas ” Hijrhey “ ki wiraasat )*

Lughwi aur istilahi maienay:

 

*Lughwi maienay*

 

Khunsa foala ke wazan par hai aur khannas se mushtaq hai. yeh narmi, murh jana aur totnay ke maienay mein aata hai. kaha jata hai khannas- ul- rajul, jab aadmi aurton ki terhan baat kere aur apni chaal, libaas waghera mein aurton se mushabihat kere.

 

*Istilahan:*

 

Khunsa hijrhey ko kehte hain. jis ki sharamgah mardon aur aurton wali ho. ya dono mein se koi bhi nah ho balkay pishaab karne ke liye aik sorakh ho aur kisi bhi sharamgah se mushaba nah ho .

 

*Woh waris jo khunsa ho satke hain:*

 

Islam mein yeh qatee tor par mumkin nahi ke maa, baap, ya khawand, biwi khunsa hon lekin darj zail waris khunsa ho satke hain.

3- Aeini, allati aur ikhyaafi bhai,

4- Aieni aur allati bhai ke betay

5- Aieni aur allati chacha

6- chacha ke betay

7- Moatiq


*Khunsa ki meeraas:*

Khunsa jis mein mard aur aurat walay dono uzoo makhsoos mojood hon ya phir dono uzwoo mein se koi bhi nah ho. balkay un ke bajaye aik sorakh ho jis se woh pishaab karta ho. aksar yeh mushahida mein aaya hai ke khunsa ke sun baloghat ko pounchanay par mard ya aurat ki alaamtain zaahir ho jati hain jaisay darhi ka nikal aana, khawaab mein mardon ki terhan ihtelaam aana, ya aurton ke terhan pistaanon ka zahir hona. aurat wali sharamgah se pishaab karna, haiz ka aana chahay zindagi mein aik hi dafaa aaye waghera waghera. agar khunsa mein mard waali alaamtain ghaalib hon to woh mard ki meeraas le ga. agar is mein aurton waali alaamtain ghaalib hon to woh aurat ki meeraas le ga .


*Khunsa ki aqsam:*

Khunsa ki do qismain hain:

1- Khunsa ghair mushkil

2- Khunsa mushkil

 

1- Khunsa ghair mushkil:- yeh woh bacha hai jis ki mustaqbil mein mard ya aurat wali alamtain zahir honay ki umeed ho. agar 1 shakhs faut ho jaye aur is ke waarison mein koi waaris khunsa aur woh abhi bacha hi ho. aur mustaqbil mein mard ya aurat ki alamtain zahir honay ki umeed ho. behtar to yeh hai ke khunsa ke baaligh honay tak jaedaad ko taqseem nah kiya jaye, lekin dosray worasa ka lehaaz rakhtay hue jaedaad ki aarzi taqseem ki ja sakti hai .


*khunsa ghair mushkil walay masla ko hal karney ka tareeqa*

Khunsa ghair mushkil ke masla ko do dafaa hal kiya jaye ga. aik dafaa khunsa ko muzakar aur doosri dafaa is ko mo’annas tasawwur karen ge. agar dono mas’alon ke asal ke darmiyan tamaasul ki nisbat ho to mazeed kisi amal ki zaroorat nahi in mein se kisi aik asal ko khunsa ki jamea banayin ge. aur har waris ko bima khunsa dono masloo mein se un ka aqal hissa den ge. aur baqi hissa ko khunsa ke sun baloghat ko pounchanay tak moqoof rakhen gaye. agar koi waaris dono masloo mein se kisi aik masla mein mahroom hota hai yani waaris nahi banta to woh khunsa ki haalat ke inkishaaf honay tak ghair waris qaraar paye ga.


*Tamaasul ki misaal:*


Misaal: Aik aurat faut ho gayi or apna khaawand, baap or beta khunsa zindah chorra jis ke haal ke inkishaaf ki umeed hai.

 

Dono masloo ka asal (12) hai un ke darmiyaan tamaasul ki nisbat hai lehaaza is ki jamea (12) hai. khaawand ko (3), baap ko (2) aur khunsa ko (6), un ke aql hissay day. aur baqi (1) khunsa ki haalat ke inkishaaf tak moqoof hai. agar khunsa mard zahir howa to baqi (1) woh le ga aur agar khunsa aurat zahir hui to baqi (1) baap le gei.

*Tabaeen ki misaal:* Agar dono masloo ke asal ke darmiyaan tabaeen ki nisbat ho to muzakar waalay asal ko mo’unnas walay asal ke sath zarb den ge. neez is asal ke tehat sab waarison ke hissay se bhi zarb den ge. is terhan mounnas walay asal ko muzakar walay asal ke sath zarb den ge. neez is ke tehat sab warison ke hissa se bhi zarb den ge phir kisi aik taseeh ko khunsa ki jamea banaiyn ge. aur har waris ko bimaa khunsa dono masloo mein se un ka aql hissa den gaye baqi hissa ko khunsa ke sun baloghat ko pounchanay tak moqoof rakhen ge.

misaal: aik aadmi faut ho gaya. aur apna beta, beti aur beta khunsa zindah chorra. mustaqbil mein us ki haalat ki inkishaaf ki umeed hai.

Is masla mein muzakar wala asal ( 5 ) hai aur mo’annas wala asal ( 4 ) hai un dono ke darmiyaan tbaeen ki nisbat hai is liye mo’annas walay asal ( 4 ) ko muzakar walay asal ( 5 ) ke sath zarb den ge. ( 20=4*5 ) haasil zarb ( 20 ) is ki tasheeh hai. is terhan muzakar walay asal ko ( 5 ) ko mo’annas walay asal ( 4 ) ke sath zarb den ge. ( 5×4 = 20 ) haasil zarb ( 20 ) is ke tashih hai. chunancha ( 20 ) is masla ki jamea hai. ab sab warison ko dono maslon mein se un ka aqal hissa den ge. is terhan betay ko ( 8 ), beti ko ( 4 ) aur multi ko ( 5 ) den ge aur baqi ( 3 ) moqoof hain. agar khunsa muzakar zahir howa to woh moqoof ( 3 ) le ga aur agar khunsa mo’annas zahir hui to beti ko mazeed ( 1 ) miley ga. aur betay ko mazeed ( 2 ) den ge .


*Tawaafuq ki misaal:*

Agar dono asolon ke darmiyaan tawafiq ki nisbat ho to muzakar walay asal ke vfaq ko mo’annas walay asal aur is ke tehat sab warison ke hisson se zarb den gaye. Is terhan moannas walay asal ke vfq ko muzakar walay asal aur is ke tehat sab warison ke hisson se zarb den ge. phir kisi aik tasheeh ko jamea banaye ge. aur khunsa samait sab warison ko dono masloo mein se un ka aqal hissa den ge. aur baqi ko moqoof kar len ge.

*Misaal:* aik aurat faut ho gayi aur apna khawand, maa aur alati bhai khunsa ko zindah chorra mustaqbil mein is ki haalat ke inkishaaf ki umeed hai.

Is misaal mein muzakar walay masla ka asal (6) hai aur mo’annas walay masla ka asal (8) hai. dono ke darmiyan tawafiq bin nisf ki nisbat hai. lehaza muzakar walay asal (6) ke vfaq (3) ko mo’annas ke asal (8) se zarb den ge. Is terhan mo’annas walay asal (8) ke vfaq (4) ko muzakar walay asal (6) se zarb den ge. Dono msloon ki tasheeh (24) hogi. chunancha is masla ki jamea (24) hogi. ab har waris ko un ka aqal hissa den ge. khawand ko (9), maa ko (6) aur khunsa ko (4) den ge. aur baqi (5) khunsa ki haalat ke inkishaaf tak moqoof rakhen ge. Agar khunsa mo’annas zahir hui to sara moqoof usay day den ge. aur agar muzakar zahir huwa to maa ko mazeed (2) aur khawand ko mazeed (3) den ge.


*Khunsa mushkil*

 

Khunsa mushkil is shakhs ko kehte hain jis ki jins baaligh honay ke baad bhi wazeh nah hui ho. ke woh mard hai ya aurat. isi terhan woh khunsa bacha bhi khunsa mushkil hi tasawwur kya jaaye ga. jo bachpan mein faut ho gaya ho aur is mein mard ya aurat wali alamtain ghalib nahi theen.


*Khunsa mushkil ki wiraasat*

 

khunsa mushkil walay maslay ko do dafaa hal kya jaye ga. aik dafaa khunsa ko muzakar aur doosri dafaa mo’annas tasawwur karen ge. lekin is ke istehqaq ke baara mein foqahaan mein ikhtilaaf paaya jata hai. is ki wajah yeh hai ke quran kareem aur hadees shareef mein is ke baray mein koi Sarih nas nahi aayi hai.

 


*Mazhab-ul-Ahnaaf*

 

Khunsa mushkil ke dono masloo ke asal ko muttahid karne ke baad khunsa mushkil ko un mein se aqal hissa diya jaye ga. agar khunsa mushkil aik aitbar se waris hota hai aur dosray aitbaar se ghair waris to woh waraasat se mahroom hoga. lekin baqi wursaan poora poora hissa len gei.


*Mazahb-ul-Shafiyah*


 

Khunsa mushkil ke dono masloo ke asal ko muttahid karne ke baad khunsa mushkil aur is ke hamrah jitne bhi waris hain. inhen dono maslon mein se aqal hissa diya jaye ga. aur jo baqi bachay ga usay sab warison ke darmiyaan baraabar baraabar ya jis terhan woh raazi hon taqseem kya jaye ga .


*Mazhab-ul- hanaabilah-wal- maalkiyah*

Khunsa mushkil ke dono mas’alon ke asal ko muttahid karne ke baad khunsa mushkil ko muzakar aur mo’annas tasawwur karne par dono sooraton mein jo hissa milta hai un ka aadha aadha hissa khunsa mushkil ko diya jaye ga. yani nisaf meersas-ul- zikr wa nisaf meeraas-ul-unsa di jaye gayi. un ke mazhab ke mutabiq khunsa mushkil walay masla ko hal karne ke liye darj zail amal karna hoga .

1- dono masloo ke asal ko muttahid karne ke baad kisi aik tashih ko le kar usay khunsa ke ahwaal ki tadaad se zarb den ge. yani agar masla mein aik hi manfi ho to tasheeh ko ( 2 ) se zarb den ge. kyunkay is masla ko do dafaa hal kiya gaya hai. agar masla mein 2 khunsa hon to tasheeh ko ( 4 ) se zarb den ge aur ( 3 ) khunsa hon to tasheeh ko ( 8 ) se zarb den gaye aur agar ( 4 ) khunsa hon to tasheeh ko ( 16 ) se zarb den ge. un ki haasil zarb khunsa mushkil ke masla ki jamea hogi.

2- dono tasheehon mein se har waris ke dono hissay bimaa khunsa mushkil jamea ke tehat likhain ge aur jama karen ge un ki haasil jama un ka hissa hoga.

 

*Note :*

 

Agar kisi masla mein do khunsa mushkil waris hon. to is masla ko ( 4 ) dafa hal karna hoga. pehli masla mein dono ko muzakar tasawwur karen ge aur dosray masla mein dono ko mo’annas tasawwur karen ge. teesray masla mein pehlay ko muzakar aur dosray ko mo’annas Aur chouthay masla mein pehlay ko mo’annas aur dosray ko muzakar tasawwur karen ge. phir sab usoolon ko muttahid karne ke baad kisi aik tasheeh ko ( 4 ) se zarb den ge aur asal zarb is masla ki jamea hogi .


Misaal#1:-

 

*Tamaasul ki misaal :*

Aik aurat apna khawand, baap aur beta khunsa mushkil zindah chorh kar faut hogai .

 

Dono maslon ke asal ke darmiyaan tamaasul ki nisbat hai. lehaza asal ( 12 ) ko khunsa ki 2 halaton se zarb diya ( 24=2×12 ) haasil zarb ( 24 ) khunsa mushkil ke masla ki jamea hai. ab khawand ko pehlay masla mein ( 3 ) aur dosray masla mein bhi ( 3 ) miley aur in ka majmoa ( 6 ) ( 6 = 3 + 3 ) khawand ko diya. baap ko pehlay masla se bhi ( 2 ) aur dosray masla se ( 3 ) miley un ka majmoa ( 2 + 3 = 5 ) ( 5 ) baap ko diya. Khunsa mushkil ko pehlay masla se ( 7 ) aur dosray masla se ( 6 ) miley un ka majmoa ( 13 =6+7 ) ( 13 ) khunsa ko diya .


misaal #2:

 

*Tabaeen ki misaal :*

1 shakhs apna beta, beti aur teesra beta khunsa mushkil chorh kar faut ho gaya. is misaal mein pehlay masla ka asal ( 5 ) hai aur dosray masla ka asal ( 4 ) hai dono ke darmiyan Tabaeen ki nisbat hai. un ki tasheeh ( 20 ) hai aur jamea ( 40 ) hai. betay Ko dono masloo mein se ( 18 ) miley beti ko ( 9 ) aur خنثی mushkil ko ( 13 ) miley .


misaal:

 

*Tawafiq ki misaal :*

Aik aurat faut hogi aur apna khawand, maa aur Aini bhai khuns mushkil ko zindah chorra .

 

muzakar walay masla ka asal ( 6 ) aur mo’annas walay masla ka asal ( 8 ) hai kyunkay is mein aul hai. dono aslon ke darmiyaan tawaafiq bin’nisaf ki nisbat hai. muzakar walay asal ( 6 ) ko ( 4 ) se zarb diya aur mo’annas walay asal ( 8 ) ko ( 3 ) se zarb diya. un ki haasil zarb ( 24 ) hai. ( 24 ) ko khunsa ki halatain ( 2 ) se zarb diya. ( 24×2 =48 ) haasil zarb ( 48 ) is masla ki jamea hai. khawand ko ( 21 ) miley. maa ko ( 14 ) miley aur khunsa ko ( 13 ) miley .
