Mukhannas “Hijday” ki wiraasat

✦ lughwi aur istilahi Maana:_

 

Lughwi Maana: خنثی, فُعلی kay wazan par hai aur خنث say mushtaq hai. Yeh narmi, mudh jana aur totnay kay Maana mein aata hai. Kaha jata hai خنث الرجل Jab aadmi aurton ki tarhan baat karay aur apni chaal, Libaas waghera mein aurton say mushabahat karay.

Istilahan: Khunsa hijday ko kehtay hain. Jis ki sharamgah mardon aur aurton wali ho. Ya donon mein say koi bhi nah ho balkeh pishaab karnay kay liye aik sorakh ho aur kisi bhi sharamgah say mushaba nah ho.

Woh waris jo khunsa ho satkay hain: Islam mein yeh qatee tor par mumkin nahi kay Maan, Baap, ya Khawand, Biwi khunsa hon lekin darj zail waris khunsa ho satkay hain.

❁ Khunsa ki meeraas:

Khunsa jis mein mard aur aurat walay donon Uzoo-e-Makhsoos mujood hon ya phir donon uzwoo mein say koi bhi nah ho. Balkeh un kay bajaye aik sorakh ho jis say woh pishaab karta ho. Aksar yeh mushahada mein aaya hai keh khunsa kay Sann-e-Buloghat ko pounchanay par mard ya aurat ki alaamtein zaahir ho jati hain jaisay dadhi ka nikal aana, Khawaab mein mardon ki tarhan ahtilaam aana, Ya aurton kay tarhan pistaanon ka zahir hona. Aurat wali sharamgah say pishaab karna, Haiz ka aana chahay zindagi mein aik hi dafaa aaye waghera waghera. Agar khunsa mein mard waali alaamtein ghaalib hon to woh mard ki meeraas lay ga. Agar us mein aurton waali alaamtein ghaalib hon to woh aurat ki meeraas lay ga.

 

❁ Khunsa ki aqsam: Khunsa ki do qismein hain:

1: Khunsa ghair mushkil                                                        2: Khunsa mushkil

 

1: Khunsa ghair mushkil: Yeh woh bacha hai jis ki mustaqbil mein mard ya aurat wali alamtein zahir honay ki umeed ho.

Agar aik shakhs faut ho jaye aur us kay waarison mein koi waaris khunsa aur woh abhi bacha hi ho. Aur mustaqbil mein mard ya aurat ki alamtein zahir honay ki umeed ho. Behtar to yeh hai keh khunsa kay baaligh honay tak jaedaad ko taqseem nah kiya jaye, Lekin dosray wurasa ka lehaaz rakhtay hue jaedaad ki aarzi taqseem ki ja sakti hai.

 

❁ Khunsa ghair mushkil walay masla ko hal karnay ka tareeqa

 

(Alif) Khunsa ghair mushkil kay masla ko do dafaa hal kiya jaye ga. Aik dafaa khunsa ko muzakkar aur doosri dafaa us ko mo’annas tasawwur karein gay. Agar donon mas’alon kay asal kay darmiyan Tamaasul ki nisbat ho to mazeed kisi amal ki zaroorat nahi in mein say kisi aik asal ko khunsa ki jamia banayin gay. Aur har waris ko bama khunsa donon masloo mein say un ka aqal hissa den gay. Aur baqi hissa ko khunsa kay Sann-e-Buloghat ko pounchanay tak muqoof rakhein gay. Agar koi waaris donon masloo mein say kisi aik masla mein mahroom hota hai yani waaris nahi banta to woh khunsa ki haalat kay inkishaaf honay tak ghair waris qaraar paye ga.

 

Tamaasul ki misaal:

Misaal: Aik aurat faut ho gai or apna Khaawand, Baap or Beta khunsa zindah choda jis kay haal kay inkishaaf ki umeed hai.

Donon masloo ka asal (12) hai un kay darmiyaan Tamaasul ki nisbat hai lehaaza is ki jamia (12) hai. Khaawand ko (3), Baap ko (2) aur khunsa ko (6), Un kay aql hissay day. Aur baqi (1) khunsa ki haalat kay inkishaaf tak muqoof hai. Agar khunsa mard zahir howa to baqi (1) woh lay ga aur agar khunsa aurat zahir hui to baqi (1) Baap lay ga.

Tabaayun ki misaal: Agar donon maslon kay asal kay darmiyaan Tabaayun ki nisbat ho to muzakkar waalay asal ko mo’unnas walay asal kay sath zarb den gay. Neez is asal kay tahat sab waarison kay hissay say bhi zarb den gay. Is tarhan mounnas walay asal ko muzakkar walay asal kay sath zarb den gay. Neez is kay tahat sab warison kay hissa say bhi zarb den gay phir kisi aik tasheeh ko khunsa ki jamia banaiyn gay. Aur har waris ko bama khunsa donon maslon mein say un ka aql hissa den gaye baqi hissa ko khunsa kay Sann-e-Buloghat ko pounchanay tak moqoof rakhein gay.

Misaal: Aik aadmi faut ho gaya. Aur apna Beta, Beti aur Beta khunsa zindah choda. Mustaqbil mein us ki haalat ki inkishaaf ki umeed hai.

Is masla mein muzakkar wala asal (5) hai aur mo’annas wala asal (4) hai in donon kay darmiyaan Tabaayun ki nisbat hai is liye mo’annas walay asal (4) ko muzakkar walay asal (5) kay sath zarb den gay. (4×5=20) Haasil-e-Zarb (20) is ki tasheeh hai. Is tarhan muzakkar walay asal ko (5) ko mo’annas walay asal (4) kay sath zarb den gay. (5×4=20) Haasil-e-Zarb (20) is kay tasheeh hai. Chunancha (20) is masla ki jamia hai. Ab sab warison ko donon maslon mein say un ka aqal hissa den gay. Is tarhan Betay ko (8), Beti ko (4) aur Khunsa ko (5) den gay aur baqi (3) moqoof hain. Agar khunsa muzakkar zahir howa to woh moqoof (3) lay ga aur agar khunsa mo’annas zahir hui to Beti ko mazeed (1) milay ga. Aur Betay ko mazeed (2) den gay.

Tawaafuq ki misaal: Agar donon asolon kay darmiyaan tawafuq ki nisbat ho to muzakkar walay asal kay wfaq ko mo’annas walay asal aur is kay tahat sab warison kay hisson say zarb den gaye. Is tarhan moannas walay asal kay wfq ko muzakkar walay asal aur us kay tahat sab warison kay hisson say zarb den gay. Phir kisi aik tasheeh ko jamia banaye gay. Aur khunsa samait sab warison ko donon maslon mein say un ka aqal hissa den gay. Aur baqi ko moqoof kar lein gay.

Misaal: Aik aurat faut ho gai aur apna Khawand, Maan aur Allati Bhai khunsa ko zindah choda mustaqbil mein us ki haalat kay inkishaaf ki umeed hai.

Is misaal mein muzakkar walay masla ka asal (6) hai aur mo’annas walay masla ka asal (8) hai. Donon kay darmiyan tawafuq bil nisf ki nisbat hai. Lehaza muzakkar walay asal (6) kay wfaq (3) ko mo’annas kay asal (8) say zarb den gay. Is tarhan mo’annas walay asal (8) kay wfaq (4) ko muzakkar walay asal (6) say zarb den gay. Donon maslon ki tasheeh (24) hogi. Chunancha is masla ki jamia (24) hogi. Ab har waris ko un ka aqal hissa den gay. Khawand ko (9), Maan ko (6) aur khunsa ko (4) den gay. Aur baqi (5) khunsa ki haalat kay inkishaaf tak moqoof rakhein gay. Agar khunsa mo’annas zahir hui to sara moqoof usay day den gay. Aur agar muzakkar zahir huwa to Maan ko mazeed (2) aur Khawand ko mazeed (3) den gay.

✦ Khunsa mushkil

 

Khunsa mushkil us shakhs ko kehtay hain jis ki jins baaligh honay kay baad bhi wazeh nah hui ho. Keh woh mard hai ya aurat. Isi tarhan woh khunsa bacha bhi khunsa mushkil hi tasawwur kiya jaaye ga. Jo bachpan mein faut ho gaya ho aur us mein mard ya aurat wali alamtein ghalib nahi theen.

 

❁ Khunsa mushkil ki wiraasat

Khunsa mushkil walay maslay ko do dafaa hal kiya jaye ga. Aik dafaa Khunsa ko muzakkar aur doosri dafaa mo’annas tasawwur karein gay. Lekin is kay istehqaq kay baara mein fuqahaa mein ikhtilaaf paaya jata hai. Is ki wajah yeh hai kay quran kareem aur hadees shareef mein is kay baray mein koi Sareeh Nass nahi aai hai.

 

❁ Mazhab-ul-Ahnaaf

Khunsa mushkil kay donon maslon kay asal ko muttahid karnay kay baad Khunsa mushkil ko un mein say aqal hissa diya jaye ga. Agar khunsa mushkil aik aitbar say waris hota hai aur dosray aitbaar say ghair waris to woh wiraasat say mahroom hoga. Lekin baqi wursaa poora poora hissa lein gay.

 

❁ Mazahb-ul-Shafiyah

Khunsa mushkil kay donon maslon kay asal ko muttahid karnay kay baad Khunsa mushkil aur us kay hamrah jitnay bhi waris hain. Unhein donon maslon mein say aqal hissa diya jaye ga. Aur jo baqi bachay ga usay sab warison kay darmiyaan baraabar baraabar ya jis tarhan woh raazi hon taqseem kiya jaye ga.

 

❁ Mazhab-ul-Hanaabilah wal Maalkiyah

Khunsa mushkil kay donon mas’alon kay asal ko muttahid karnay kay baad Khunsa mushkil ko muzakkar aur mo’annas tasawwur karnay par donon sooraton mein jo hissa milta hai un ka aadha aadha hissa Khunsa mushkil ko diya jaye ga. Yani nisaf Meersas-ul-Zikr wa nisf Meeraas-ul-Unsaa di jaye gai. In kay mazhab kay mutabiq Khunsa mushkil walay masla ko hal karnay kay liye darj zail amal karna hoga.

(Alif) donon maslon kay asal ko muttahid karnay kay baad kisi aik tasheeh ko lay kar usay Khunsa kay ahwaal ki tadaad say zarb den gay. Yani agar masla mein aik hi Khunsa ho to tasheeh ko (2) say zarb den gay. Kiunkeh is masla ko do dafaa hal kiya gaya hai. Agar masla mein 2 Khunsa hon to tasheeh ko (4) say zarb den gay aur (3) khunsa hon to tasheeh ko (8) say zarb den gaye aur agar (4) khunsa hon to tasheeh ko (16) say zarb den gay. In ki Haasil-e-Zarb Khunsa mushkil kay masla ki jamia hogi.

(Bey) donon tasheehon mein say har waris kay donon hissay ba maa Khunsa mushkil jamia kay tahat likhein gay aur jama karein gay un ki Haasil-e-Jama un ka hissa hoga.

Note: Agar kisi masla mein do Khunsa mushkil waris hon. To is masla ko (4) dafa hal karna hoga. Pehli masla mein donon ko muzakkar tasawwur karein gay aur dosray masla mein donon ko mo’annas tasawwur karein gay. Teesray masla mein pehlay ko muzakkar aur dosray ko mo’annas Aur chouthay masla mein pehlay ko mo’annas aur dosray ko muzakkar tasawwur karein gay. Phir sab usoolon ko muttahid karnay kay baad kisi aik tasheeh ko (4) say zarb den gay aur asal zarb is masla ki jamia hogi.

 

Misaal 1: Tamaasul ki misaal: Aik aurat apna Khawand, Baap aur Beta Khunsa mushkil zindah chodh kar faut hogai.

Donon maslon kay asal kay darmiyaan Tamaasul ki nisbat hai. Lehaza asal (12) ko Khunsa ki 2 halaton say zarb diya (12×2=24) Haasil-e-Zarb (24) Khunsa mushkil kay masla ki jamia hai. Ab Khawand ko pehlay masla mein (3) aur dosray masla mein bhi (3) milay aur in ka majmoa (6) (3+3=6) Khawand ko diya. Baap ko pehlay masla say bhi (2) aur dosray masla say (3) milay un ka majmoa (2+3=5) (5) Baap ko diya. Khunsa mushkil ko pehlay masla say (7) aur dosray masla say (6) milay un ka majmoa (7+6=13) (13) Khunsa ko diya.

Misaal  2: Tabaayun ki misaal: Aik shakhs apna Beta, Beti aur teesra Beta Khunsa mushkil chodh kar faut ho gaya. Is misaal mein pehlay masla ka asal (5) hai aur dosray masla ka asal (4) hai donon kay darmiyan Tabaayun ki nisbat hai. In ki tasheeh (20) hai aur jamia (40) hai. Betay ko donon maslon mein say (18) milay Beti ko (9) aur خنثی mushkil ko (13) milay.

Misaal 3: Tawafuq ki misaal: Aik aurat faut hogai aur apna Khawand, Maan aur Aini Bhai Khunsa mushkil ko zindah choda.

muzakkar walay masla ka asal (6) aur mo’annas walay masla ka asal (8) hai kiunkeh is mein auwl hai. Donon asalon kay darmiyaan tawaafuq bil nisaf ki nisbat hai. Muzakkar walay asal (6) ko (4) say zarb diya aur mo’annas walay asal (8) ko (3) say zarb diya. In ki Haasil-e-Zarb (24) hai. (24) ko Khunsa ki halatein (2) say zarb diya. (24×2=48) Haasil-e-Zarb (48) is masla ki jamea hai. Khawand ko (21) milay. Maan ko (14) milay aur khunsa ko (13) milay.
