Kia do saal ki muddat tak Qayaam karne waala musaafir qasar kare?

Mere aur ek ‘Arab dost ke darmiyaan Namaz qasar karne ke baare mein jhagda hoa soorat-e-haal yeh hai ke hum aaj kal America mein Qayaam pazeer hain aur mumkin hai ke do saal tak yeh Qayaam rahe mein to Namaz poori padhta hoon goya ab apne hi mulk mein hoon jab ke mera dost Namaz-e-qasar padhta hai aur kehta hai ke mein to musaafir hoon khuwah safar ki muddat do saal tak taweel kio na ho. Umeed hai ke aap hamare is qasar-e-Namaz ke masla mein daleel ke saath rehnumaai farmaaein ge?

[Jawab]

Asal yeh hai ke musaafir woh hai jis se rubaa’i Namaz qasar karne ki rukhsat hai jaisa ke Irshaad-e-Bari Ta’ala hai:

وَاِذَا ضَرَبۡتُمۡ فِى الۡاَرۡضِ فَلَيۡسَ عَلَيۡكُمۡ جُنَاحٌ اَنۡ تَقۡصُرُوۡا مِنَ الصَّلٰوةِ ‌

(Al-Nisaa 40 101)

“Aur jab tum safar ko jaao to tum par kuch gunaah nahi ke Namaz ko kam karke padho.”

Aur Ya’ala-bin-Umaya se riwaayat hai ke main ne Hazrat ‘Umar-bin-Khattaab رضى الله عنه ki khidmat mein ‘arz kiya ke Irshaad-e-Baari Ta’ala to yeh hai ke:

فَلَيۡسَ عَلَيۡكُمۡ جُنَاحٌ اَنۡ تَقۡصُرُوۡا مِنَ الصَّلٰوةِ ‌ۖ اِنۡ خِفۡتُمۡ اَنۡ يَّفۡتِنَكُمُ الَّذِيۡنَ كَفَرُوۡا‌ ؕ

(Al-Nisaa 40 101)

“Tum par kuch gunaah nahi ke Namaz ko kam kar ke padho basharteke tum ko khauf ho ke kaafir log tum ko aiza dein ge.”

To unhon ne farmaaya ke mujhe bhi is se ta’jjub hoa jis se aap ko ta’jjub hoa to main ne is silsila mein Rasoolullah (ﷺ) se ‘arz kiya to aap ne farmaaya:

هِيَ صَدَقَةٌ تَصَدَّقَ اللهُ بِهَا عَلَيْكُمْ فَاقْبَلُوا صَدَقَتَهُ)

(Sahih Muslim, Kitaab Salaat Al-Musafireen-o-Qasarha, Baab Salaat Al-Musafireen-o-Qasarha, H: 686)

“Yeh Allah Ta’ala ne tum par sadqa farmaaya hai lehaaza Allah Ta’ala ke is sadqa ko qubool kar lo”.

Aur bilf’el iss se musaafir ke hukm mein shumaar kiya jaae ga jo chaar din raatein ya is se kam muddat ke liye Qayaam kare jaisa ke Hadees-e-Jaabir-o-Ibn-e-‘Abbas رضى الله عنهم se saabit hai ke hajjat-ul-Wida’ ke mouq’a par Nabi Kareem (ﷺ) chaar Zi Al-Hajja ki subah ko Makkah Mukarma mein tashreef laae aur aap ne Zi Al-Hajja ki chaar , Paanch , Chey aur saat tareekh ko Makkah hi mein Qayaam farmaaya aur phir aath tareekh ko subah ki Namaz Abtahh mein adaa farmaai Un tamaam dinon mein aap ne Namaz-e-qasar padhi aur yahan aap ki iqaamat ki niyyat thi jaisa ke ma’loom hai lehaaza har woh shakhs jo musaafir ho aur us ki itni muddat iqaamat ki niyyat ho jitni ke Rasoolullah (ﷺ) ki thi ya us se kam muddat ki niyyat ho to woh Namaz-e-qasar padh sakta hai aur agar niyyat us se ziyaada iqaamat ki ho to woh poori Namaz padhe ga kyunke woh musaafir ke hukm mein na ho ga.

Jo shakhs apne safar mein chaar din se ziyaada iqaamat to ikhtiyaar kar le lekin us ki iqaamat ki niyyat na ho balkeh iraadah yeh ho ke joon hi us ki zaroorat poori ho gai woh wapas laut jaae ga maslan koi shakhs dushman se jihaad ke liye kisi jagah muqeem ho ya kisi ko baadshah ne rok liya ho ya koi kisi marz ki wajah se rukney par majboor ho gaya ho aur niyyat yeh ho ke joon hi jihaad ka marhala fatah-o-nusrat ya sulaah ki shakal mein mukammal ho gaya ya joon hi us ne marz ya dushman ya baadshah ya apne saamaan-e-tijaarat ki furookht se faraaghat paali to woh wapas laut jaae ga to is soorat mein us se musaafir samjha jaae ga aur us se rubaa’i Namaz ke qasar ki ijaazat ho gi khuwah yeh muddat kitni hi taweel kio na ho jaae kyunke Hadees se yeh saabit hai ke Fataah-e-Makkah ke saal Nabi (ﷺ) ne Makkah Mukarma mein unees din Qayaam farmaaya aur un dinon mein aap Namaz-e-qasar adaa farmaate rahe. Isi tarah ‘Isaaiyon se jihaad ke liye aap ne Tabook mein unatees din Qayaam farmaaya aur un dinon mein bhi aap ne Hazraat Sahaaba Karaam رضى الله عنهم ke saath Namaz-e-qasar adaa farmaai kyunke aap ki iqaamat ki baqaaida niyyat na thi balkeh niyyat yeh thi ke joon hi zaroorat poori ho gai Aap safar shur’u farma dein ge!
